Abstract
Indonesia menganut sistem pendaftaran tanah negatif, yang bertendensi positif.
Maksud dari pengertian ini adalah sistem pendaftaran tanah menggunakan sistem
negatif yang masih memungkinkan terjadinya klaim pengakuan hak atas tanah,
tetapi di sisi lain Pemerintah berupaya untuk memperoleh fakta sebenarnya
mengenai klaim hak atas tanah. Penjelasan umum dari PP No. 10 Tahun 1961
merupakan bukti berlakunya sistem pendaftaran tanah negatif yang bertendensi
positif. Di dalam penjelasan umum tersebut kepastian hukum diberikan kepada
yang benar-benar berhak atas tanah, sedangkan yang terdaftar di dalam buku tanah
masih dapat digugat. Tipe penelitian yang dipilih adalah yuridis normatif dengan
sifat deskriptif analisis dan jenis data yang digunakan adalah data sekunder. Hasil
penelitian dianalisis secara kualitatif untuk selanjutnya ditarik kesimpulan secara
deduktif. Perkara Nomor 437/Pdt.G/2018/PN.Jkt.Tim merupakan salah satu bukti
dari berlakunya sistem publikasi negatif yang mengandung unsur positif, dimana
AJB yang telah dilakukan pertama kali di hadapan PPAT atas suatu bidang tanah
dapat memberikan kepastian hukum bahwa telah terjadinya pemindahan hak atas
tanah. Sehingga Sertipikat yang telah terbit diatas tanah tersebut milik orang lain
dinyatakan tidak sah dan tidak mengikat secara hukum. / Indonesia adheres to a negative land registration system, which has a positive
tendency. The meaning of this definition is that the land registration system uses a
negative system that still allows claims for land rights recognition, but on the other
hand the Government is trying to obtain actual facts regarding land rights claims.
General explanation of PP No. 10 of 1961 is evidence of the implementation of a
negative land registration system with a positive tendency. In the general
explanation, legal certainty is given to those who are truly entitled to the land, while
those registered in the land book can still be sued. The type of research chosen is
normative juridical with descriptive analysis and the type of data used is secondary
data. The results of the study were analyzed qualitatively for further conclusions
drawn deductively. Case Number 437/Pdt.G/2018/PN.Jkt.Tim is one of the
evidences of the implementation of a negative publication system that contains
positive elements, where AJB which has been carried out for the first time before
PPAT on a parcel of land can provide legal certainty that there has been a transfer
of land rights. So that the certificate that has been issued on the land belonging to
another person is declared invalid and not legally binding.
