The law governing regulations on cooperatives has changed, which was originally number 25 of 1992 concerning cooperatives and then replaced by law number 17 of 2012. The birth of law 17 of 2012 replaced Act No. 25 of 1992 concerning Cooperatives was deemed to have several weaknesses and inherited the tradition of colonial cooperatives which then filed a lawsuit against the Law Number 17 of 2012 Concerning Cooperatives. The impact of the Constitutional Court Decision affects the formation of cooperatives to return to the previous law, where the procedure and its implementation for the notary in the case of the formation of the cooperative must now follow the rules and procedures for the establishment of cooperatives as regulated in Law Number 25 of 1992. Problems What is stated about the roles and responsibilities of a notary to the cooperative deed that was made after the decision of the CONSTITUTIONAL COURT No.28 / PUU-XI / 2013? What is the Legal Status of the Cooperative Deed After the Constitutional COURT Decision No.28 / PUU-XI / 2013? The research method used is a normative juridical approach by analyzing the results of interviews with the Notarial Cooperative Deed Maker. The analysis was also carried out on CONSTITUTIONAL COURT Decision number 28 / PUU-IX / 2013. The nature of the research is analytical descriptive, which is conducting a qualitative analysis so that a systematic, factual, and accurate picture is obtained. From the results of the study, it can be concluded that the notarial deed of the cooperative's deed must urge that the cooperative be able to adjust the Statutes / ART as a whole with the provisions of Law Number 25 of 1992. the implementation of the Act must follow the rules that become positive law and the implementing regulations, as well as in legal protection of the Notary of the Cooperative deed. / Undang-Undang yang mengatur tentang peraturan mengenai koperasi mengalami perubahan yang dimana awalnya Nomor 25 Tahun 1992 Tentang Perkoperasian lalu digantikan menjadi Undang-Undang Nomor 17 Tahun 2012. Lahirnya undang-undang 17 Tahun 2012 menggantikan Undang-Undang No. 25 Tahun 1992 tentang Perkoperasian dinilai memiliki beberapa kelemahan dan mewarisi tradisi perkoperasian kolonial yang lalu diajukan gugatan Uji materil terhadap UndangUndang Nomor 17 Tahun 2012 Tentang Perkoperasian. Dampak dari Putusan Mahkamah Konstitusi tersebut mempengaruhi tatacara pembetukan koperasi untuk kembali ke Undang-undang yang terdahulu, yang dimana tatacara dan pelaksanaanya bagi Notaris dalam hal pembentukkan koperasi saat ini harus mengikuti Peraturan dan tatalaksana pendirian koperasi sebagaimana yang diatur dalam Undang Nomor 25 Tahun 1992. Permasalahan yang dikemukakan Bagaimana peran dan tanggung jawab notaris terhadap akta koperasi yang telah dibuat setelah putusan MAHKAMAH KONSTITUSI No.28/PUU-XI/2013? Bagaimana Status Hukum Akta Koperasi yang Telah Dibuat Pasca Putusan MAHKAMAH KONSTITUSI No.28/PUU-XI/2013? Metode Penelitian yang digunakan merupakan pendekatan yuridis normatif dengan menganalisis hasil wawancara dengan Notaris Pembuat Akta Koperasi. Analisa juga dilakukan terhadap Putusan MAHKAMAH KONSTITUSI Nomor 28/PUU-IX/2013. Sifat penelitian adalah deskriptif analitis yakni melakukan analisa kualitatif sehingga didapat gambaran secara sistematik, faktual, akurat Dari hasil penelitian dapat disimpulkan notaris pembuat akta koperasi harus menghimbau agar koperasi dapat menyesuaikan AD/ART secara menyeluruh dengan ketentuan Undang-Undang Nomor 25 Tahun 1992. Notaris sebagai pelakasana Undang-Undang harus mengikuti peraturan yang menjadi hukum positif dan peraturan pelaksananya, serta dalam perlindungan hukum terhadap Notaris Pembuat akta Koperasi.
