Secara normatif pengaturan mengenai pengadaan barang dan jasa memberi kontribusi signifikan terhadap efisiensi belanja negara dan perekonomian nasional. Namun dalam praktiknya, masih ditemukan penyimpangan yang berpotensi pelanggaran hukum. Penelitian ini secara tematik mengkaji prinsip-prinsip pengaturan pengadaan barang dan jasa pemerintah, pelaksanaan metode pengadaan langsung, terutama yang terkait dengan praktik pinjam nama perusahaan, dan pengaturan yang ideal dalam perspektif keadilan bermartabat. Metodologi penelitian yang digunakan adalah penelitian hukum normatif, yang didukung dengan kajian empiris, khususnya yang menyangkut praktik pinjam nama perusahaan. Adapun pendekatan analisa mendasarkan pada pendekatan perundang-undangan (statute approach), pendekatan komparatif (comparative approach), serta pendekatan konseptual (conceptual approach). Sebagai landasan teori, penelitian ini menggunakan Teori Kepastian Hukum, Teori Efektivitas Hukum, dan Teori Keadilan Bermartabat. Temuan hasil penelitian menunjukkan bahwa pengadaan barang dan jasa pemerintah, khususnya metode pengadaan langsung dalam perspektif Teori Keadilan Bermartabat berpotensi menyimpang dari prinsip-prinsip pengadaan. Sementara itu, pinjam nama perusahaan selain bertentangan dengan moral, juga tidak memenuhi kriteria iktikad baik perjanjian. Hal itu dapat menjadi unsur pidana karena memberikan informasi palsu atau penipuan. Penerapan asas bertindak cermat (principle of carefulness) harus menjadi dasar dalam pengaturan pengadaan barang dan jasa pemerintah. Lebih dari itu, untuk menjamin kepastian hukum, praktik pinjam nama perusahaan harus dilarang secara tegas dalam undang-undang, seiring dengan penerapan prinsip transparansi, dan keterbukaan, dengan dukungan prosedur berbasis sarana elektronik. / formatively the regulation regarding the procurement of goods and services contributes significantly to the efficiency of state spending and the national economy. However, in practice, deviations are still found that have the potential to violate the law. This research thematically examines the principles of government procurement of goods and services, the implementation of direct procurement methods, especially those related to the practice of borrowing company names, and the ideal arrangement in the perspective of dignified justice. The research methodology used is normative legal research, which is supported by empirical studies, especially those concerning the practice of borrowing company names. The analytical approach is based on a statutory approach, a comparative approach, and a conceptual approach. As a theoretical basis, this research uses the Theory of Legal Certainty, Theory of Legal Effectiveness, and Theory of Dignified Justice. The findings of the research show that the procurement of government goods and services, especially the direct procurement method in the perspective of the Dignified Justice Theory, has the potential to deviate from the principles of procurement. Meanwhile, borrowing a company name is not only against morals, it also does not meet the criteria of good faith agreement. It can be a criminal element for providing false or fraudulent information. The application of the principle of carefulness must be the basis in regulating the procurement of government goods and services. Moreover, to ensure legal certainty, the practice of borrowing company names must be strictly prohibited by law, along with the application of the principles of transparency and fairness , supported by the procedures based on electronic system.
