The Production Sharing Contract mechanism with Cost Recovery schemes applied in Indonesia is regulated in the Law of the Republic of Indonesia No. 22 of 2001 concerning Oil and Natural Gas. Cost Recovery is an operating cost that can be returned by the government to the contractor for all operating costs incurred by the contractor in exploring oil and gas. The profit sharing system between the Government and KKKS occurs after previously being reduced by Cost Recovery, which is the return of oil and gas exploration and exploitation costs from the Government to the Cooperation Contract Contractors (KKKS) and paid in the form of oil and gas production, which is assessed by Weighted Average Price (WAP), namely the weighted average price is calculated based on the lifting value for one year divided by the number of lifting units during the same period. This research is a type of normative law research that uses normative case studies in the form of legal behavior products, such as reviewing laws. The subject matter of the study is the law conceptualized as a norm or norm that applies in society and becomes a reference for everyone's behavior so that normative legal research focuses on an inventory of positive law, legal principles and doctrines, legal discoveries in concreto cases, systematic law, level of synchronization, comparative law and legal history. This study is used to review the legal review of the Cost Recovery Clause in the Production Sharing Contract in the petroleum and natural gas industry, by reviewing the Laws and Regulations concerning Cost Recovery in the Production Sharing Contract and the principle of freedom of contract associated with factual conditions that apply in society today based on data collected from various literature. As for the principle of freedom of contract, there is a freedom in determining the contents of the contract of cooperation agreement in this case the Production Sharing Contract with the Cost Recovery scheme, the contents of the agreement or the production sharing contract must still follow the provisions contained in the Act namely the provisions contained in the Act RI No. 22 of 2001 concerning Oil and Natural Gas. By applying the principle of freedom of contract in the production sharing agreement, it is hoped that the principle of justice will also be realized in the State of Indonesia. / Mekanisme Production Sharing Contract dengan skema Cost Recovery yang diterapkan di Indonesia diatur dalam Undang-Undang Republik Indonesia No. 22 Tahun 2001 tentang Minyak dan Gas Bumi. Cost Recovery merupakan biaya operasi yang dapat dikembalikan oleh pemerintah kepada kontraktor atas seluruh biaya operasi yang dikeluarkan oleh kontraktor dalam mengeksplorasi migas. Sistem bagi hasil antara Pemerintah dengan KKKS terjadi setelah sebelumnya dikurangi dengan Cost Recovery yang merupakan pengembalian biaya eksplorasi dan ekspoitasi migas dari Pemerintah kepada Kontraktor Kontrak Kerja Sama (KKKS) dan dibayarkan dalam bentuk produksi migas, yang dinilai dengan Weighted Average Price (WAP), yaitu harga rata-rata tertimbang dihitung berdasarkan nilai lifting selama satu tahun dibagi dengan jumlah satuan lifting selama periode yang sama. Penelitian ini merupakan jenis penelitian hukum normative (normative law research) yang menggunakan studi kasus normatif berupa produk perilaku hukum, misalnya mengkaji undang-undang. Pokok kajiannya adalah hukum yang dikonsepkan sebagai norma atau kaidah yang belaku dalam masyarakat dan menjadi acuan perilaku setiap orang sehingga penelitian hukum normatif berfokus pada inventarisasi hukum positif, asas-asas dan doktrin hukum, penemuan hukum dalam perkara in concreto, sistematik hukum, taraf sinkronisasi, perbandingan hukum dan sejarah hukum.Penelitian ini digunakan untuk mengkaji tinjauan hukum atas Klausula Cost Recovery dalam Production Sharing Contract di bidang industri minyak bumi dan gas alam, dengan mengkaji Peraturan Perundang-Undangan mengenai Cost Recovery dalam Production Sharing Contract dan asas kebebasan berkontrak yang dikaitkan dengan kondisi faktual yang berlaku di masyarakat saat ini berdasarkan data-data yang dikumpulkan dari berbagai literatur. Adapun berdasarkan asas kebebasan berkontrak, terdapat sebuah kebebasan dalam menentukan isi dari kontrak perjanjian kerjasama dalam hal ini Production Sharing Contract dengan skema Cost Recovery, isi dari perjanjian atau kontrak bagi hasil tersebut tetap harus mengikuti ketentuan yang terdapat dalam Undang Undang yaitu ketentuan yang terdapat dalam UU RI No. 22 Tahun 2001 tentang Minyak dan Gas Bumi. Dengan menerapkan asas kebebasan berkontrak dalam kontrak perjanjian bagi hasil tersebut maka diharapkan prinsip keadilan juga akan terwujud di dalam Negara Indonesia.
