Abstract

Dalam suatu akta peralihan piutang (cessie) akibat hukum adalah hal yang harus diperhatikan. Berdasarkan Pasal 613 KUHPerdata menegaskan penyerahan akan piutang atas nama dan kebendaan tak bertubuh lainnya dilakukan dengan jalan membuat sebuah akta otentik atau akta dibawah tangan dengan mana hak hak katas kebendaan itu dilimpahkan kepada orang lain. Penyerahan piutang ini tidak ada akibatnya bagi yang berutang sebelum penyerahan diberitahukan dan disetujui secara tertulis atau diakui oleh Debitur/Peminjam. Keberadaan akta otentik atau akta dibawah tangan diperlukan sebagai cara menyerahkan atau mengalihkan hak milik atas piutang yang bersangkutan dari kreditur kepada pihak ketiga. Piutang yang dialihkan secara cessie adalah suatu tagihan yang dimiliki oleh kreditur atas debiturnya yang adalah tagihan atas nama. Pada dasarnya tagihan atas nama menunjukkan dengan jelas kreditur yang berhak menerima pembayaran. Hal ini terjadi dalam pengalihan piutang yang terjadi antara Bank Jtrust Indonesia (Kreditur Lama) dengan J Trust Investments Indonesia (kreditur baru). Peralihan piutang yang terjadi antara Bank Jtrust dengan J Trust Investments Indonesia berakibat hukum terhadap pengikatan jaminan yang telah dipasang hak tanggungan. Dalam pelaksanaannya penulis menggunakan metode Yuridis Normatif yaitu dengan dimulai dengan analisis bahan hukum primer, bahan hukum sekunder dan tersier secara normatif berdasarkan pendekatan konseptual dan peraturan perundangundangan atau pendekatan lain yang sesuai dengan rumusan masalah. Dari hasil penelitian tersebut dapat disimpulkan bahwa akta peralihan piutang nomor 41 berdasarkan Pasal 1320 KUH Perdata dan Pasal 613 KUH Perdata Maka akta peralihan piutang nomor 41 ini dapat dikatakan telah sesuai dengan ketentuan. Pendaftaran pengalihan hak tanggungan dari kreditur lama kepada kreditur baru akibat terjadinya cessie, kreditur baru cukup memberitahukan pada Kantor Pertanahan dengan mendaftarkan peralihan hak tanggungan dari kreditur lama untuk atas nama kreditur baru. / In a deed of transfer of receivables (cessie) legal consequences are things that must be done note Based on Article 613 of the Civil Code confirms that the submission will receivables in the name and other intangible objects are carried out by way ofmake an authentic deed or a deed under the hand with which the rights. The material word is delegated to someone else. The delivery of this receivable is not there are consequences for those who owe before the delivery is notified and approved in writing or acknowledged by the Borrowing Debtor. The existence of an authentic deed or an underhand deed is needed as a way of handing over or transferring rights ownership of the relevant receivables from creditors to third parties Receivables cessie transferred is a claim that is owned by the creditor on the debtor which is a bill on behalf of basically a bill on behalf of clearly indicate which creditors are entitled to receive payments. This matter occurred in the transfer of receivables between Bank trust Indonesia (Old Creditor) with J Trust Investments Indonesia (new creditor). Switch receivables between Bank trust and J Trust Investments Indonesia legal consequences for the binding of guarantees that have been installed dependents. In its implementation, the author uses the Juridical method Normative, namely by starting with the analysis of primary legal materials, secondary and tertiary law normatively based on a conceptual approach and laws and regulations or other appropriate approaches formulation of the problem. From the results of this study it can be concluded that the deed transfer of receivables number 41 based on Article 1320 of the Civil Code and Article 613 Civil Code Then the deed of transfer of receivables number 41 can be said to have been according to criteria. Registration of transfer of mortgage rights from creditors old creditors to new creditors due to cessie, new creditors are enough notify the Land Office by registering the transfer of rights dependents of the old creditor on behalf of the new creditor.
