Merger is a form of centralization of economic activities that are often used by business actors for business development. Such mergers could potentially lead to monopolistic practices. Merger arrangement in business competition law in Indonesia is regulated in Article 28 and Article 29 of Undang-Undang Nomor 5 Tahun 1999. In Article 29 regulation concerning obligation of notification to KPPU with certain threshold value of merger. Because it is deemed to have weaknesses in the prevailing notification system, the Government and the People's Legislative Assembly formulate a Business Competition Law to correct weaknesses regarding the notification system. As for the background of this research is, How the regulation of notification merger according to Undang-Undang Nomor 5 Tahun 1999? and How the provision of merger notification under the Draft Law on Prohibition of Monopolistic Practices and Unfair Business Competition? The type of research metedology is normative with prescriptive characteristics, and the writing of this uses statute approach method and conceptual approach. The result of the research is the regulation of notification of merger in UndangUndang Nomor 5 Tahun 1999 is post notification in the form of mandatory notice after merger is executed, with sanction in the form of merger cancellation if potentially causing monopolistic practice and voluntary consultation, . Whereas in the Business Competition Bill, the notification procedure is pre notification in the form of notification to KPPU by appraisal before merger is done to fix the weakness of the post notification system canceling the merger after it has been executed causing the loss for the business actor. Suggestions that can be given post-notification system should be changed into pre notification system, and Draft Competition Law is immediately approved by the People's Legislative Assembly. / Merger merupakan bentuk pemusatan kegiatan ekonomi yang sering digunakan pelaku usaha untuk pengembangan usaha. Merger tersebut dapat berpotensi menimbulkan praktik monopoli. Pengaturan Merger dalam hukum persaingan usaha di Indonesia di atur dalam Pasal 28 dan Pasal 29 Undang-Undang Nomor 5 Tahun 1999. Dalam pasal 29 diatur mengenai kewajiban pemberitahuan (notifikasi) kepada KPPU dengan batasan nilai/threshold merger tertentu. Karena dianggap memiliki kelemahan pada sistem notifikasi yang berlaku, Pemerintah dan DPR membentuk RUU Persaingan Usaha untuk memperbaiki kelemahan mengenai sistem notifikasi. Adapun yang menjadi latar belakang penulisan ini adalah Bagaimana pengaturan mengenai notifikasi merger menurut Undang-Undang Nomor 5 Tahun 1999? dan Bagaimana ketentuan notifikasi merger menurut Rancangan Undang-Undang Tentang Larangan Praktek Monopoli Dan Persaingan Usaha Tidak Sehat? Jenis Penelitian yang dilakukan bersifat normatif dengan karakteristik preskriftif, penelitian ini menggunakan metode pendekatan undang-undang (statute approach) dan pendekatan konseptual (conseptual approach). Kesimpulan dari penelitian ini adalah pengaturan notifikasi merger dalam Undang-Undang Nomor 5 Tahun 1999 bersifat post notifikasi berupa pemberitahuan yang bersifat wajib (mandatory) setelah merger terlaksana, dengan sanksi berupa pembatalan merger apabila berpotensi menyebabkan praktik monopoli, dan konsultasi yang bersifat sukarela (voluntary). Sedangkan dalam RUU Persaingan Usaha pengaturan notifikasi bersifat pre notifikasi berupa pemberitahuan kepada KPPU dengan dilakukan penilaian sebelum merger terlaksana untuk memperbaiki kelemahan sistem post notifikasi yang membatalkan merger setelah terlaksana yang menyebabkan kerugian bagi pelaku usaha. Saran yang dapat diberikan sistem post notifikasi sepatutnya diubah menjadi sistem pre notifikasi, dan RUU Persaingan Usaha segera disahkan oleh DPR RI.
