Abstract
Sebagai salah satu pejabat umum, Notaris dapat menjamin kepastian serta
perlindungan hukum melalui akta otentik yang dibuat oleh atau dihadapannya.
Dalam proses pembuatan akta, sangat penting bagi Notaris untuk memeriksa
kelengkapan dokumen yang berhubungan dengan pembuatan akta. Karena
ketidakhati-hatian dari Notaris dapat menimbulkan akibat hukum yang harus
dipertanggungjawabkan oleh Notaris, hal tersebutlah yang melatarbelakangi
penulis untuk menganalisa putusan Mahkamah Agung No.272PK/Pdt/2020. Tujuan
penelitian dan penulisan tesis ini adalah untuk mengetahui pertimbangan hukum
hakim terhadap pembatalan akta sewa menyewa yang dibuat oleh Notaris dalam
putusan pengadilan dan untuk mengetahui kepastian hukum bagi para pihak
terhadap akta sewa menyewa yang dibuat oleh notaris dalam putusan pengadilan.
Penelitian ini merupakan penelitian yuridis normatif untuk mengetahui bagaimana
pertimbangan hakim dalam putusan Mahkamah Agung No.272PK/Pdt/2020,
dengan menggunakan pendekatan Undang-Undang, Pendekatan Kasus, dan
Pendekatan Konseptual. Sumber data yang dipergunakan dalam penelitian ini
adalah sumber data primer. Berdasarkan hasil penelitian dan pembahasan dapat
disimpulkan bahwa harta bersama yang didapat selama perkawinan selagi tidak ada
Perjanjian Perkawinan maka atas harta bersama tersebut sesuai pasal 36 ayat (1)
Undang-Undang No. 1 tahun 1974 tentang Perkawinan, mengharuskan adanya
persetujuan dari pasangan suami/istri apabila ingin bertindak atas harta bersama,
sehingga dapat disimpulkan terhadap Akta Sewa Menyewa No. 24 tanggal 29
Agustus 2013 yang dibatalkan oleh Hakim, jelas tidak memenuhi syarat objektif
dalam suatu perjanjian karena tidak adanya persetujuan pasangan dalam akta
tersebut. Dalam hal ini, penggugat merupakan suami dari tergugat VI yang mana
sudah sepatutnya menurut undang-undang apabila tergugat VI sebagai istri sah
ingin bertindak untuk dan atas harta bersama harus mendapat persetujuan dari
pasangannya yaitu penggugat. /As a registrar, a notary can guarantee legal certainty and protection by an authentic
deed made by or before him. In the process of making the deed, it is very important
for the Notary to verify the complete document requirements pursuant to the
drawing up of the deed. Because the notary's carelessness can cause to legal
consequences that must be accounted for by the Notary, this is the background for
the author to analyze the Supreme Court's Judgement No.272PK/Pdt/2020. The
purpose of research and writing this thesis is to find out the ratio decidendi of the
judge on the cancellation of the lease deed made by a notary in a court decision and
to find out the legal certainty for the parties to the lease deed made by a notary in a
court decision. This research is a normative juridical research to find out how the
ratio decidendi in the Supreme Court's Judgement No.272PK/Pdt/2020, using the
Law approach, Case Approach, and Conceptual Approach. Sources of data used in
this research is primary data sources. Based on the results of the research and
discussion, it can be concluded that the joint assets obtained during the marriage
while there is no Prenuptial Agreement, the joint property is in accordance with
Article 36 paragraph (1) of Law no. 1 of 1974 concerning Marriage, requires the
consent of the husband/wife if they want to act on joint assets, therefore it can be
concluded that the Deed of Lease No. 24 dated August 29, 2013 which was canceled
by the Judge, clearly did not meet the objective requirements in an agreement
because there was no spouse's consent in the deed. In this case, the plaintiff is the
husband of Defendant VI, which according to law is appropriate if Defendant VI as
a wife wants to act for and on joint assets, must obtain approval from her partner,
namely the Plaintiff.
