Abstract

Surat Kuasa Membebankan Hak Tanggungan (SKMHT) merupakan surat kuasa khusus yang dibuat untuk menjadi dasar pembuatan Akta Pemberian Hak Tanggungan (APHT), apabila si pemberi hak tanggungan tidak dapat hadir dihadapan PPAT atau sertifikat belum terdaftar. Permasalahan yang dihadapi adalah bagaimana peran Notaris/PPAT dalam pembuatan akta SKMHT dan APHT bagi Kreditur dan Debitur ? Dan bagaimana akibat hukum APHT yang Dibuat Berdasarkan SKMHT terkait dengan Putusan Mahkamah Agung Nomor 3218 K/Pdt/2019 ? Metode penelitian yang digunakan adalah penelitian yuridis normatif yaitu mengkaji hukum yang dikonsepkan sebagai norma atau kaidah yang berlaku dalam masyarakat, dan menjadi acuan perilaku setiap orang. Hasil penelitian menunjukkan bahwa peran Notaris/PPAT dalam pembuatan akta SKMHT dan APHT bagi kreditur dan debitur adalah menjembatani antara kepentingan debitur dengan kepentingan kreditur, sehingga kedua belah pihak sama-sama mendapatkan rasa keadilan, kemanfaatan, dan kepastian hukum dalam melakukan pengikatan jaminan hak tanggungan. PPAT membuat akta APHT yang memiliki kekuatan eksekutorial, apabila suatu hari nanti pihak nasabah melakukan cidera janji. Akibat hukum APHT yang dibuat berdasarkan SKMHT terkait dengan Putusan Mahkamah Agung Nomor 3218 K/Pdt/2019 adalah batal demi hukum. hal ini mengacu pada Pasal 15 ayat (3) tentang “SKMHT mengenai hak atas tanah yang sudah terdaftar wajib diikuti dengan pembuatan APHT selambat-lambatnya 1 (satu) bulan sesudah diberikan”, sehingga akibat dari dilanggarnya Pasal 15 ayat (3), maka sesuai dengan Pasal 15 ayat (6) disebutkan “SKMHT yang tidak diikuti dengan pembuatan APHT dalam waktu yang ditentukan, sebagaimana dimaksud pada ayat (3) atau ayat (4) atau waktu yang ditentukan menurut ketentuan sebagaimana dimaksud dalam ayat (5) adalah batal demi hukum”. Notaris/PPAT dalam membuat akta tidak boleh berpihak dan harus teliti. / Power of Attorney for Imposing Mortgage (SKMHT) is a special power of attorney made to be the basis for making the Deed of Granting Mortgage (APHT), if the mortgagee cannot present in front of the Land Titles Registrar (PPAT) or the certificate hasn’t been registered, the mortgagee is obliged to appoint another person as his proxy by making the Power of Attorney. The problem faced is what is the role of Notary Public / Land Titles Registrar in making Power of Attorney for Imposing Mortgage (SKMHT) and the Deed of Granting Mortgage (APHT) for creditors and debtors ? And what are the legal consequences of the Deed of Granting Mortgage made based on Power of Attorney for Imposing Mortgage related to Supreme Court Desicion Number 3218 K/PDT/2019 ? The research method used is normative judicial research, namely examining laws that are conceptualized as norms or rules that apply in society, and become a reference for everyone’s behavior. The result shows that the role of Notary Public / Land Titles Registrar in making the Power of Attorney for Imposing Mortgage (SKMHT) and the Deed of Granting Mortgage (APHT) for creditors and debtors is to bridge the interests of the debtor with the interests of the creditor, so both parties will get sense of justice, benefit, and legal certainty in binding mortgage guarantees. The Land Titles Registrar makes the Deed of Granting Mortgage that has executive power, if one day the customer makes a breach of contract. The legal consequences of the Deed of Granting Mortgage made based on the Power of Attorney for Imposing Mortgage related to Supreme Court Decision Number 3218 K/PDT/2019 are null and void. This refers to Article 15 paragraph (3) concerning that the “Power of Attorney for Imposing Mortgage (SKMHT) concerning registered land rights must be followed by making the Deed of Granting Mortgage (APHT) not more than 1 (one) month after being granted”, so that the result of violating Article 15 paragraph (3), then in accordance with Article 15 paragraph (6) states Power of Attorney for Imposing Mortgage which is not followed by Deed of Granting Mortgage within the specified time, as reffered to paragraph (3) or paragraph (4) or the time determined according to the provisions as reffered to in paragraph (5) is null and void by law. Public Notary / Land Titles Registrar in making the deed must not take sides and must be careful.
