Abstract

Patent protection is often accused of being the reasons behind the diffculty for people to get access to drugs. To overcome this problem various efforts have been made by the Government of Indonesia to provide the required easy access, including through regulations on patents implementation in Indonesia, which have been regulated since 1989 up until 2016. On the other hand, the Indonesian government, being a member international agreements on the protection of intellectual property rights, especially the TRIPS Agreement, are required to provide protection for intellectual property rights whose minimum standards of protection are regulated by the TRIPS Agreement. This research is conducted to analyze the consistency between the provisions on patent implementation obligations in Indonesia, specifically those stipulated in Law 13/2016, and the norms of the TRIPS Agreement and also to analyze the conception within the Patent Law in order to increase access to medicinal products in Indonesia. This study is conducted using legislation approach and descriptive analysis research type. The collection of the legal materials is carried out by collecting secondary data through library studies (library research) which reviews written legal information derived from publicly published sources. From the results of the study, it can be concluded that the provisions on patent implementation obligations in Indonesia, in principle, are in line with the norms of the TRIPS Agreement. However, what should be noted is that the provisions contained in the Patent Law have not been able to fully increase public access to drugs. Increasing access to medicines cannot only rely solely on patents legislation but must also involve all stakeholders so that the goals of increasing public access to medicines can be achieved. / Perlindungan paten seringkali dituding menjadi penyebab sulitnya masyarakat mendapatkan akses terhadap obat-obatan. Untuk mengatasi permasalahan ini berbagai usaha telah dilakukan oleh Pemerintah Indonesia untuk memberikan kemudahan akses kepada masyarakat, diantaranya melalui peraturan tentang pelaksanaan paten di Indonesia, yang telah diatur semenjak tahun 1989 sampai dengan tahun 2016. Sementara itu di satu sisi, pemerintah Indonesia yang juga menjadi anggota perjanjian internasional tentang perlindungan hak kekayaan intelektual, khususnya Persetujuan TRIPS, diharuskan untuk memberikan perlindungan atas hak kekayaan intelektual yang standard minimum perlindungannya sudah diatur oleh Persetujuan TRIPS. Untuk itu maka penelitian ini dilakukan untuk menganalisa konsistensi ketentuan kewajiban pelaksanaan paten di Indonesia, khususnya yang diatur di dalam UU 13/2016 dengan norma Persetujuan TRIPS dan menganalisa konsepsi pengaturan Undang-Undang Paten dalam rangka meningkatkan akses terhadap produk obat-obatan di Indonesia. Penelitian dilakukan secara yuridis normatif dengan tipe penelitian analisis deskriptif. Pengumpulan bahan hukum dilakukan dengan pengumpulan data sekunder melalui studi kepustakaan (library resesarch) yang mengkaji informasi hukum tertulis yang berasal dari sumber-sumber yang dipublikasikan secara umum. Dari hasil penelitian kemudian dapat disimpulkan ketentuan kewajiban pelaksanaan paten di Indonesia pada prinsipnya sudah sejalan dengan norma Persetujuan TRIPS. Namun demikian yang pelu menjadi catatan adalah ketentuan yang terdapat di dalam Undang-Undang Paten belum dapat sepenuhnya meningkatkan akses masyarakat terhadap obat-obatan. Peningkatan akses terhadap obat-obatan tidak dapat semata-mata hanya mengandalkan peraturan perundang-undangan di bidang paten tetapi juga harus melibatkan keseluruhan pemangku kepentingan agar cita-cita meningkatkan akses masyarakat terhadap obat-obatan dapat tercapai.
