Abstract

This thesis entitled “Protection of Creditor’s Rights on Syndicated Loan in Bankruptcy Case” attempts to disclose and examine and seek answers to legal issues on how legal protection for creditors on syndicated loans from debtor declared bankrupt and how the distribution of collateral which is a bankruptcy property for the creditor of syndication loan. By using the normative juridical approach of the approach undertaken by reviewing all laws and regulations pertaining to this legal issue. Then it is concluded that there is a guarantee for the syndicated creditor participant to be able to collect and obtain the right to pay the receivables in a relatively short time, which is guaranteed in Article 2 paragraph (1) of the Indonesian Bankruptcy Act and the distribution of proceeds from the sale of bankrupt property is done in the order of priority where the higher-creditor earns a preferred from another creditors of a lower position, and between creditors of the same level receives payment on the prorated principle (pari passu prorata parte). / Tesis ini berjudul “Perlindungan Hak Kreditur atas Kredit Sindikasi (Syndication Loan) dalam Perkara Kepailitan” berupaya untuk mengungkapkan dan meneliti serta mencari jawaban permasalahan hukum yakni Bagaimana perlindungan hukum bagi para kreditur atas kredit sindikasi dari debitur yang dinyatakan pailit, dan bagaimana pembagian jaminan yang merupakan harta pailit bagi para kreditur kredit sindikasi. Dengan menggunakan pendekatan yuridis normatif yakni pendekatan yang dilakukan dengan menelaah semua undang-undang dan regulasi yang bersangkut paut dengan isu hukum ini. Maka diperoleh suatu kesimpulan bahwa adanya jaminan bagi kreditur peserta sindikasi untuk dapat menagih dan mendapatkan hak pembayaran piutang dalam waktu yang relatif singkat, yang dijamin dalam Pasal 2 ayat (1) UndangUndang Kepailitan dan pembagian hasil penjualan harta pailit, dilakukan berdasarkan urutan prioritas di mana kreditur yang kedudukannnya lebih tinggi mendapatkan pembagian lebih utamakan dari kreditor lain yang kedudukannya lebih rendah, dan antara kreditur yang memiliki tingkatan yang sama memperoleh pembayaran dengan asas prorata (pari passu prorata parte).
