Abstract

Since the issuance of Supreme Court Regulation No. 2 of 2015 concerning Procedures for Settling Small Claim Court brought changes to the world of Justice in Indonesia, particularly related to businessman in the field of credit distribution for handling bad loans (default) with a relatively fast resolution of 25days work from the date of the first session in the court. Moreover, the opportunity was not opened for the opportunity to provide an appeal, cassation or case review. Supreme Court Regulation Number 2 of 2015 have made businessman not affraid to provide credit to debtors with collateral for land and buildings that have not been registered. If the debtor defaults, the creditor able to provide a Small Claim Court as the basis for executing the collateral, a substitute for Mortgage. This court verdict through a Small Claim Court have the same legal force as Mortgage, which is to provide an Executive Title with the meanings "FOR JUSTICE BASED ON THE ALMIGHTY GOD." Development of that Law Procedure was a research topic that the author discussed with a normative juridical approach and used empirical data. The results of the study show that the Court's Decision through a Small Claim Court can provide legal certainty to the creditor against the collateral of land that have not been registered to be executed to pay off debtor debts. Execution through this Small Claim Court have the same legal certainty as the strength of the Mortgage for land have registered as the collateral. / Diberlakukannya Peraturan Mahkamah Agung Nomor 2 Tahun 2015 tentang Tata Cara Penyelesaian Gugatan Sederhana, membawa perubahan pada dunia Peradilan di Indonesia, khususnya terkait dengan pelaku usaha di bidang penyaluran kredit untuk penanganan kredit macet (wanprestasi) dengan tenggang waktu penyelesaian putusan yang relatif cepat yaitu 25 hari kerja terhitung sejak tanggal sidang pertama. Lebih dari itu, juga tidak dibuka kesempatan mengajukan upaya banding, kasasi atau peninjauan kembali. Perma Nomor 3 Tahun 2015 ini membuat pelaku usaha berani memberikan kredit kepada debitur dengan jaminan tanah dan bangunan yang belum bersertifikat. Apabila debitur wanprestasi maka kreditur akan mengajukan Gugatan Sederhana di Pengadilan Negeri sebagai dasar untuk melakukan eksekusi jaminan, merupakan pengganti Hak Tanggungan. Putusan Pengadilan melalui Gugatan Sederhana ini memiliki kekuatan hukum yang sama dengan Hak Tanggungan yaitu memberikan Title Eksekutorial dengan irah-irah “DEMI KEADILAN BERDASARKAN KETUHANAN YANG MAHA ESA.” Perkembangan Hukum Acara itu menjadi topik penelitian yang penulis bahave dengan pendekatan yuridis normatif serta menggunakan data empiris. Haveil Penelitian menunjukan bahwa Putusan Pengadilan melalui Gugatan Sederhana dapat memberikan kepastian hukum kepada kreditur terhadap jaminan tanah adat yang belum bersertifikat untuk dieksekusi guna melunasi utang-utang debitur. Eksekusi melalui Gugatan sederhana ini memiliki kepastian hukum yang sama dengan kekuatan Hak Tanggungan atas jaminan tanah yang telah bersertifikat.
