Abstract

At present the most common activities carried out in the community are buying and selling activities, where the parties involved are consumers and business actors. The relationship between business actors and consumers sometimes leads to consumer disputes. In carrying out the buying and selling activities, the position of consumers is more susceptible in the event that their rights are not fulfilled and consumers try to fight for their rights by filing complaints or filing claims, but the business actor responds with defensive actions in the form of counterattacks known as Strategic Lawsuits Against Public Participation. The problem is how is the legal protection for consumers who get defensive actions from business actors known as the Strategic Lawsuits Against Public Participation. The author uses normative legal research methods that are supported to answer these problems. Business actors should not sue the consumer, because consumer complaints are actions protected by law. It would be better if complaints made by consumers were made as a source of information for businesses to improve the quality of goods production and / or services. The suggestion that can be given by the author is the need to improve the regulation of business actors, it is needed by business actors who can position complaints as important information for improving the quality of their production. Therefore a regulation is needed that can accommodate for the future so that there are no similar problems. This regulation can be done by means of legal transplants or also known as legal transplants or legal borrowings such as those that already exist in the State of California, United States in the Code of Civil Procedure section 425.16 and 425.17 with interference from the state. / Saat ini kegiatan yang paling umum dilakukan dalam masyarakat adalah kegiatan jual-beli, dimana pihak yang terlibat di dalamnya adalah konsumen dan pelaku usaha. Hubungan antara pelaku usaha dengan konsumen terkadang menimbulkan sengketa konsumen. Dalam melaksanakan kegiatan jual-beli tersebut, posisi konsumen lebih rentan dalam hal tidak terpenuhinya hak mereka dan konsumen berusaha untuk memperjuangkan haknya dengan melakukan pengaduan atau dengan mengajukan gugatan, akan tetapi pelaku usaha menanggapinya dengan tindakan defensif berupa serangan balik dengan gugatan yang dikenal dengan istilah Strategic Lawsuits Agaisnt Public Participation. Permasalahannya adalah bagaimana perlindungan hukum bagi konsumen yang mendapatkan tindakan defensif dari pelaku usaha yang dikenal dengan istilah Strategic Lawsuits Agaisnt Public Participation tersebut. Penulis menggunakan metode penelitian hukum normatif yang didukung untuk menjawab permasalahan tersebut. Pelaku usaha tidak seharusnya menggugat balik konsumen tersebut, karena pengaduan konsumen merupakan tindakan yang dilindungi oleh undang-undang. Akan lebih baik jika pengaduan yang dilakukan konsumen dijadikan sebagai suatu sumber informasi bagi pelaku usaha untuk memperbaiki mutu produksi barang dan/atau jasanya. Saran yang dapat diberikan oleh penulis ialah perlu dibenahinya pengaturan mengenai pelaku usaha, dibutuhkan pelaku usaha yang dapat memposisikan pengaduan sebagai suatu informasi penting bagi peningkatan mutu produksinya. Karena itu dibutuhkan suatu peraturan yang dapat mengakomodir untuk masa yang akan datang sehingga tidak terjadi masalah serupa. Peraturan tersebut dapat dilakukan dengan cara transplantasi hukum atau dikenal juga dengan istilah legal transplant atau legal borrowing seperti yang sudah ada di Negara Bagian California, Amerika Serikat dalam Code of Civil Procedure section 425.16 dan 425.17 dengan campur tangan dari negara.
