Abstract
The purpose of the research was to properly know the role of restorative justice in the settlement of cyber bullying by children reviewed from Law No.19 of 2016 on
changes to Law No.11 of 2008 on Information and Electronic Transactions (ITE) and The Juvenile Criminal Justice System Act, and also preventive efforts to prevent cyber
bullying to children, in order to realize security for children in carrying out their social life in cyberspace. This type of research is empirical normative research using library research methods and obtained directly from the public.The study uses secondary data consisting of secondary legal materials, primary legal materials, and tertiary legal
materials.The collection of legal materials in this study uses literature study techniques and interview techniques.The research approach used is a legal systematic approach and a case approach that is then analyzed using qualitative analysis techniques.
The research has result that showed the resolution against cyber bullying carried out by children is different from law enforcement against cyber bullying by adults, because of Law No.11 of 2012 on the Juvenile Criminal Justice System that strongly protects children as both victims and perpetrators. Reviewed from Law No.19 of 2016 on Amendments to Law No.11 of 2008 on Information and Electronic Transactions
(ITE), children who are perpetrators of cyber bullying cannot be sanctioned as stated in article 45 paragraph (3) and paragraph (4) of Law No.19 in 2016, due to its own
provisions in Law No.11 of 2012 concerning the Juvenile Criminal Justice System.
Law No.11 of 2012 prioritizes the interests of children regarding the growth and development of children, both in terms of physical, mental, and social children. Law No.11 of 2012 exposes the Juvenile Justice System by using a restorative justice and diversion approach to resolve criminal events experienced and/or committed by children, with the intention of avoiding or distancing children from stigmatization of children who face the law and are expected to return to the social environment properly./ Tujuan dari penelitian ini adalah untuk mengetahui secara baik peran restorative justice dalam penyelesaian tindak pidana cyber bullying oleh anak ditinjau dari Undang-Undang No. 19 Tahun 2016 tentang Perubahan Atas Undang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (ITE) dan Undang-Undang Sistem Peradilan Pidana Anak, serta upaya preventif guna mencegah terjadinya cyber bullying pada anak, agar mewujudkan keamanan bagi anak dalam menjalankan kehidupan bersosialisasi atau pergaulannya di dunia maya. Jenis penelitian ini merupakan penelitian normatif empiris dengan menggunakan metode penelitian kepustakaan (library research) dan yang didapat langsung dari masyarakat. Penelitian
ini menggunakan data sekunder yang terdiri dari bahan hukum sekunder, bahan hukum primer, dan bahan hukum tersier. Pengumpulan bahan hukum dalam penelitian ini menggunakan teknik studi kepustakaan dan teknik wawancara. Pendekatan penelitian yang digunakan adalah pendekatan sistematika hukum dan pendekatan kasus yang kemudian dianalisis dengan menggunakan teknik analisis kualitatif.
Hasil penelitian menunjukkan bahwa penyelesaian perkara cyber bullying yang dilakukan oleh anak berbeda dengan penyelesaian perkara cyber bullying yang dilakukan orang dewasa, karena adanya Undang-Undang No. 11 tahun 2012 tentang Sistem Peradilan Pidana Anak yang sangat melindungi anak baik selaku korban maupun pelaku. Ditinjau dari Undang-Undang No. 19 tahun 2016 tentang Perubahan Atas Undang-Undang No. 11 tahun 2008 tentang Informasi dan Transaski Elektronik, anak yang menjadi pelaku tindak pidana cyber bullying tidak dapat diberikan sanksi sebagaimana yang tertera pada pasal 45 ayat (3) dan ayat (4) Undang-Undang No. 19 tahun 2016, karena adanya ketentuan tersendiri dalam Undang-Undang No. 11 tahun 2012 tentang Sistem Peradilan Pidana Anak.
Undang-Undang No. 11 tahun 2012 tersebut mengutamakan kepentingan anak yang menyangkut pertumbuhan dan perkembangan anak, baik dari sisi fisik, mental, maupun sosial anak. Undang-Undang No. 11 tahun 2012 memaparkan sistem peradilan pidana anak dengan menggunakan pendekatan restorative justice dan diversi untuk menyelesaikan peristiwa tindak pidana yang dialami dan/atau dilakukan oleh
anak, dengan maksud menghindari atau menjauhkan anak dari stigmatisasi terhadap anak yang berhadapan dengan hukum dan diharapkan anak dapat kembali ke dalam lingkungan sosial secara wajar.
