Abstract

This study aims to determine law enforcement against the crime of hate speech and defamation on social media in case Number: 58/Pid.Sus/2019/PT.DKI and to find out legal considerations by the panel of judges in case Number: 58/Pid. Sus/2019/PT. DKI. This research uses normative-juridical method by examining library materials or secondary data as the basis for analyzing related regulations. Sources of data used in this study are primary data in the form of data sourced from the Directory of Decisions of the Supreme Court of the Republic of Indonesia and secondary data consisting of primary, secondary, and tertiary legal materials. The data that the authors have collected will be analyzed descriptively analytically with a qualitative approach to get the answers from the problems. The results of the study show that law enforcement against the crime of hate speech and defamation on social media in Case Number: 58/Pid.Sus/2019/PT.DKI is determined in the provisions stipulated in the law. Law enforcement carried out against perpetrators of spreading hate speech who has been proven to meet the elements of committing the act is punished according to Article 45A paragraph (2) as amended by Article 28 paragraph (2) of the Law of the Republic of Indonesia Number 19 of 2016 concerning Amendments to Laws. Law Number 11 of 2008 concerning Information and Electronic Transactions in conjunction with Article 55 paragraph (1) of the 1st Criminal Code. Legal considerations by the Panel of Judges in Case Number: 58/Pid.Sus/2019/PT.DKI was carried out before the judge's decision by taking into account the demands of the public prosecutor, the memorandum of defense of the defendant's legal counsel, and the judge's considerations as well as juridical, non-juridical considerations and other circumstances aggravating and mitigating the position of the accused./ Penelitian ini bertujuan untuk mengetahui penegakan hukum terhadap tindak pidana ujaran kebencian serta pencemaran nama baik di media sosial dalam perkara Nomor : 58/Pid.Sus/2019/PT.DKI dan untuk mengetahui pertimbangan hukum oleh majelis hakim dalam perkara Nomor : 58/Pid.Sus/2019/PT.DKI. Penelitian ini dilakukan dengan menggunakan metode penelitian normatif- yuridis dengan meneliti bahan pustaka atau data sekunder sebagai bahan dasar dalam melakukan analisa pada peraturan terkait. Sumber data yang digunakan dalam penelitian ini adalah data primer berupa data yang bersumber dari Direktori Putusan Mahkamah Agung RI dan data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Data yang telah penulis kumpulkan akan dianalisis secara deskriptif analitis dengan pendekatan kualitatif untuk mendapatkan jawaban atas permasalahan. Hasil penelitian menunjukkan bahwa penegakan hukum terhadap tindak pidana ujaran kebencian serta pencemaran nama baik di media sosial dalam Perkara Nomor : 58/Pid.Sus/2019/PT.DKI ditentukan dalam ketentuan yang telah diatur dalam undang-undang. Penegakan hukum yang dilakukan terhadap pelaku penyebaran ujaran kebencian yang telah terbukti memenuhi unsur-unsur melakukan perbuatan tersebut dihukum menurut Pasal 45A ayat (2) sebagaimana telah diubah dengan Pasal 28 ayat (2) Undang-Undang Republik Indonesia Nomor 19 Tahun 2016 Tentang Perubahan Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik juncto Pasal 55 ayat (1) ke-1 KUHPidana. Pertimbangan hukum oleh Majelis Hakim dalam Perkara Nomor : 58/Pid.Sus/2019/PT.DKI dilakukan sebelum putusan hakim dengan mempertimbangkan tuntutan jaksa penuntut umum, nota pembelaan penasehat hukum terdakwa dan pertimbangan hakim sendiri serta pertimbangan yuridis, non-yuridis serta keadaan yang memberatkan dan meringankan posisi terdakwa.
