Abstract
In indonesia every element expect the investmen climate can work properly
so it can benefit the goverment and especially the investmen society. The better and
safer in carrying out the business of the investors, the greater the profit that will be
obtained in the future. The main purpose of the investors to invest is to get benefit
as much as possible. Even though investors have been running their business well
there is a possibility raises the issue or event of default therein. To control that risk,
when they want to invest, an agreement arises between the two parties. The
agreement was bound through a deal whereby in order to obtain permanent legal
force, it was stated in the Deed. In this case the author tries to delve deeper into
how an investment agreement that creates default so that the Deed of Sale was born
to pay off its obligations and how the execution of the debt agreement and can the
power of attorney be withdrawn. After the author conducts research and review of
this case, it can be concluded that the deed of sale should not be for transferring
ownership rights to the power of attorney, but only represent the
principal/authorizer as the seller as mandated by the deed of sale. Based on the
provisions, a power of attorney may terminate or be withdrawn if the
authorizer/principal makes a new power of attorney followed by notification of the
matter to the recipient of the power of attorney and / or the exception that the
principal/authorizer dies. / Di Indonesia setiap elemen berharap iklim investasi dapat berjalan dengan
baik sehingga dapat bermanfaat bagi pemerintah dan terutama masyarakat investor.
Semakin baik dan aman dalam menjalankan bisnis para investor, semakin besar
keuntungan yang akan diperoleh di masa depan. Tujuan utama para investor untuk
berinvestasi adalah untuk mendapatkan manfaat sebanyak mungkin. Meskipun
investor telah menjalankan bisnisnya dengan baik, ada kemungkinan timbulnya
masalah atau peristiwa gagal bayar di dalamnya. Untuk mengendalikan risiko itu,
ketika mereka ingin berinvestasi, muncul kesepakatan antara kedua pihak.
Perjanjian tersebut terikat melalui kesepakatan di mana untuk mendapatkan
kekuatan hukum permanen, itu dinyatakan dalam Akta. Dalam hal ini penulis
mencoba menggali lebih dalam tentang bagaimana suatu perjanjian investasi yang
menciptakan wanprestasi sehingga Deed of Sale dilahirkan untuk melunasi
kewajibannya dan bagaimana pelaksanaan perjanjian utang dan bagaimana surat
kuasa dapat ditarik. Setelah penulis melakukan penelitian dan peninjauan kasus ini,
dapat disimpulkan bahwa akta penjualan tidak boleh untuk mentransfer hak
kepemilikan kepada kuasa, tetapi hanya mewakili kepala sekolah / penulis sebagai
penjual sebagaimana diamanatkan oleh akta penjualan. . Berdasarkan ketentuan
tersebut, surat kuasa dapat diberhentikan atau ditarik kembali jika pemberi kuasa /
kepala sekolah membuat surat kuasa baru diikuti dengan pemberitahuan tentang
masalah tersebut kepada penerima surat kuasa dan / atau pengecualian bahwa
kepala sekolah / pemberi kuasa meninggal.
