Abstract

The house is a primary requirement for most family, both for living in rural and also in urban which representing primary requirement. Accomplishment pf primary requirement, cannot fulfill by everybody to buy cash. Therefore it requires a financial institution to provide financial addistance in the form of loans, especially House Ownership Credit (KPR). This study aims to determine how role of the Notary and Land Deed Offials in deed in connection with House Ownership Credit (KPR) mainly for land that has been a certificate so it can be made buying and seeling and mortgage for land that has not been certificate and can not be carried out sale and purchase and the binding process morgagate up process covernote notary. In deed relating to iwnership housing loan (KPR) is land deed Officials must pay attention to the rules and norms. The deed will become evidance in transition right object purchase. / Rumah adalah kebutuhan primer bagi sebagian besar keluarga, baik yang tinggal di pedesaan maupun di perkotaan. Pemenuhan kebutuhan primer tersebut, tidak dapat dipenuhi oleh semua orang untuk membeli secara tunai. Oleh karena itu, diperlukan suatu lembaga keuangan untuk memberikan bantuan dana dalam bentuk kredit terutama adalah kredit pemilikan rumah (KPR). Penelitian ini bertujuan untuk mengetahui bagaimana peran Notaris dan PPAT dalam hal pembuatan akta sehubungan dengan kredit pemilikan rumah (KPR) terutama untuk tanah yang sudah bersertipikat sehingga dapat dilakukan Jual Beli dan pembebanan hak tanggungan dan untuk tanah yang belum bersertipikat sehingga belum dapat dilakukan jual beli dan proses pengikatan jaminan sampai dengan proses penerbitan surat keterangan (cover note) dari Notaris/PPAT. Dalam membuat akta perjanjian jual beli, PPAT harus memperhatikan dan mentaati peraturan-peraturan dan norma yang berlaku, karena akta-akta tersebut akan menjadi alat bukti dalam proses peralihan hak atas obyek jual beli.
