Abstract
This thesis examines the violation of the Land Acquisition Authorities where in the
making of the deed of sale is not in accordance with the actual price of legal
action. As a public official, PPAT is responsible for his or her own office and the
authentic deed he made. The PPAT often forgets the code of ethics and the oath of
office that he utters, thereby violating. In this research, the Author raised two (2)
main issues, the first is How the legal consequences of land sales law that does
not correspond to the actual price by the PPAT? , and How does the impact of the
Deed of Sale and Purchase be inconsistent with the actual price of the transfer of
land title? This study uses normative juridical methods that emphasize written
legal norms with juridical approaches utilizing secondary data sources, used to
analyze various laws and regulations in the field of Notaries, civil and criminal
law fields, books and articles of law, articles that have a correlation and
relevance to the issues studied. The result of this research shows that the
responsibilities of the PPAT and its related parties to the actions of PPAT are
PPAT can be given administrative sanction, while from the aspect of civil law the
parties may be liable to sanction for compensation for lawsuit, and from criminal
aspect of the Parents Parties may be penalized for falsification of deeds. The legal
consequences of the act of the PPAT and the parties to the act are that the act
remains authentic for not being denied. / Tesis ini meneliti mengenai pelanggaran Pejabat Pembuat Akta Tanah
yang dimana dalam membuat akta jual beli tidak sesuai dengan harga sebenarnya
dalam perbuatan hukum. Sebagai pejabat umum, PPAT bertangggung jawab
terhadap jabatannya dan akta autentik yang dibuatnya. PPAT seingkali melupakan
kode etik dan sumpah jabatan yang diucapkannya, sehingga kemudian melakukan
pelanggaran. Dalam penelitian ini, Penulis menangkat 2 (dua) pokok
permasalahan, yang pertama adalah Bagaimana akibat hukum akta jual beli tanah
yang tidak sesuai dengan harga sebenarnya oleh PPAT? ,dan Bagaimana
pengaruh Akta Jual Beli yang dibuat tidak sesuai dengan harga sebenarnya
terhadap peralihan permohonan hak atas tanah? Penelitian ini menggunakan
metode yuridis normatif yang menekankan pada norma-norma hukum tertulis
dengan pendekatan yuridis yang mempergunakan sumber data sekunder,
digunakan untuk menganalisis berbagai peraturan perundang-undanganan di
bidang jabatan Notaris, bidang hukum perdata dan bidang hukum pidana, bukubuku dan artikel-artikel yang mempunyai korelasi dan relevan dengan
permasalahan yang diteliti. Hasil dari penelitian ini menunjukkan bahwa tanggung
jawab PPAT beserta pihak terkait terhadap perbuatannya tersebut dari aspek
jabatan PPAT adalah PPAT dapat diberikan sanksi administratif, sedangkan dari
aspek hukum perdata para pihak dapat dikenakan sanksi ganti rugi atas gugatan
perbuatan melawan hukum, dan dari aspek hukum pidana Para Pihak dapat
dijatuhi hukuman terkait pemalsuan akta. Akibat hukum atas perbuatan PPAT dan
para pihak tersebut terhadap aktanya adalah akta tersebut tetap autentik selama
tidak dimintakan pembatalan.
