Abstract
Notaris merupakan pejabat umum yang memiliki kewenangan untuk membuat Akta Autentik, salah satunya adalah Akta Perjanjian Pengikatan Jual Beli dan Akta Kuasa Menjual. Dalam praktik masih terdapat permasalahan hukum mengenai kelalaian Notaris dalam menjalankan jabatannya yang melanggar ketentuan dalam Undang-Undang Jabatan Notaris yang membuat Notaris terjerat dalam kasus pidana yang dilakukan baik dengan sengaja ataupun turut serta melakukan tindak pidana. Salah satu bentuk tindak pidana yang dilakukan oleh Notaris yaitu adalah penipuan. Tesis ini membahas mengenai bagaimana pertanggungjawaban perdata Notaris dan keabsahan akta yang mengandung unsur tindak pidana penipuan yang telah diputus pidana berdasarkan putusan Pengadilan Negeri Denpasar Nomor 1460/Pid.B. 2019/PN.Dps. Penelitian ini menggunakan metode yuridis normatif dengan jenis data sekunder yang diperoleh dari studi kepustakaan yang kemudian dianalisis secara kualitatif. Hasil dari penelitian ini adalah tanggung jawab perdata Notaris yang melakukan penipuan tersebut telah memenuhi unsur-unsur dari Pasal 1365 Kitab Undang-Undang Hukum Perdata mengenai perbuatan melawan hukum, sehingga keabsahan Akta Perjanjian Pengikatan Jual Beli dan Akta Kuasa Menjual milik Feba Debora adalah batal demi hukum serta Akta Perjanjian Pengikatan Jual Beli dan Akta Kuasa Menjual antara Tugiman dan Susilowati Go tidak memenuhi syarat sah perjanjian yang mengakibatkan Akta tersebut dapat dimintakan pembatalan di Pengadilan. / Notary is a public official who has the authority to issued Authentic Deeds, one of which is the Deed of Sale and Purchase Binding Agreement and the Deed of Authorization to Sell. In practice there are still legal problems regarding the negligence of Notary in carrying out their position, violates the provisions of the Notary Position Act which made the Notary entangled in criminal cases that are committed either intentionally or participating in criminal acts. One form of crime committed by a notary is fraud. This thesis discusses how the civil liability of a Notary and the validity of a deed containing elements of a criminal act of fraud has been decided based on the decision of Pengadilan Negeri Denpasar Nomor 1460/Pid.B. 2019/PN.Dps. This study uses a normative juridical method with secondary data types obtained from literature studies which analyzed qualitatively. The result of this study is that the civil liability of the Notary who committed the fraud has fulfilled the elements of Article 1365 of the Civil Code regarding unlawful acts, so that the validity of the Deed of Sale and Purchase Binding Agreement and the Deed of Authorization to Sell belonging to Feba Debora are null and void and Deed of Sale and Purchase Binding Agreement and the Deed of Authorization to Sell between Tugiman and Susilowati Go did not meet the legal requirements of the agreement, which results in cancellation of Deed can be requested in the Court.
