Abstract

Notaris sebagai pejabat umum dalam membuat akta autentik wajib bertopang pada Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris (UUJN) dan Kode Etik Notaris guna menjaga kredibilitasnya. Namun praktiknya seringkali terjadi penggugatan karena terjerat perbuatan melawan hukum dalam akta autentik sehingga dapat diminta pertanggungjawabannya berdasarkan sifat pelanggaran dan akibat hukum yang ditimbulkan. Ini menjadi pemikiran untuk dilakukan penelitian bertujuan memberikan wawasan tambahan tentang pertanggungjawaban Notaris sebagai tergugat dalam pembuatan akta Perjanjian Pengikatan Jual Beli berdasarkan UUJN dan memahami legalitas keabsahan akta yang telah dibuat oleh Notaris apabila dalam pembuatan akta Perjanjian Pengikatan Jual Beli yang memiliki unsur perbuatan melawan hukum. Metode penelitian yang digunakan adalah yuridis normatif, menggunakan data sekunder yang diperoleh dari studi kepustakaan dengan bahan hukum primer yaitu peraturan hukum, didukung bahan hukum sekunder dan tersier kemudian dianalisis secara kualitatif. Perbuatan yang dilakukan oleh Notaris dalam membuat akta Perjanjian Pengikatan Jual Beli tanpa sepengetahuan dan persetujuan pemilik sertipikat merupakan perbuatan melawan hukum. Kesimpulannya adalah dengan terbuktinya Notaris sebagai tergugat maka dapat diminta pertanggungjawaban secara administatif, kode etik, perdata maupun pidana. Terkait dengan perbuatannya, Notaris didalamnya harus membayar ganti rugi kepada penggugat dan legalitas akta dicabut oleh pengadilan yang mengakibatkan batal demi hukum. / Notary as a public official in making authentic deeds must rely on Law of The Republic of Indonesia Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 on Office Of Notary Public (UUJN) and the Notary Code of Ethics in order to maintain their credibility. However, in practice there are often lawsuits against Notaries due to the involvement of unlawful acts in making authentic deeds so that they can be held accountable based on the nature of the violation and the legal consequences that arise. This is the rationale for conducting research with the aim of providing additional insight into the Notary's responsibility as a defendant in the making of the Sale and Purchase Binding Agreement deed based on the UUJN and understanding the legality of the legality of the deed that has been made by the Notary if in the making of the Sale and Purchase Binding Agreement deed that has an element of action. against the law. The research method used is normative juridical, using secondary data obtained from literature studies with primary legal materials, namely legal regulations, supported by secondary and tertiary legal materials and then analyzed qualitatively. Actions carried out by a Notary in making a Sale and Purchase Binding Agreement deed without the knowledge and approval of the certificate owner are against the law. The conclusion is that with the proof of a Notary as a co-defendant, it can be held accountable administratively, code of ethics, civil and criminal. In relation to his actions, the Notary must pay compensation to the plaintiff and the legality of the deed is revoked by the court which results in null and void.
