The deed which is an authentic deed must fulfill the conditions, namely subjective and objective. Dead will is an agreement. In the event that the deed does not meet the objective requirements, then the effect will be null and void by law. If the Notary is not found guilty of involvement in making the deed, the judge's consideration is not appropriate. Although the will is a partij deed where the Notary is not responsible for the correctness of the contents of the deed, but if he sees the obligation of the Notary then the Notary must be careful in carrying out legal acts. The purpose of the research and writing of this thesis is to find out the position of the will deed canceled by the judge in the court ruling and the notary's responsibility for the will deed canceled by the judge in the court decision. This research is a normative juridical study which analyzes the decision of the DKI Jakarta High Court No. 805 / PDT / 2018 / PT.DKI using the Law approach, Case Approach, and Conceptual Approach. The data sources used in this study are secondary data sources. Based on the results of the research and discussion it can be concluded that based on the Civil Code Provisions regarding the legal requirements of an agreement must meet the objective requirements namely certain things and halal causes, so that it can be concluded that the Deed submitted by the Judge does not meet the objective requirements, namely the lawful reason because it violates the Law Invite so it's null and void. / Akta wasiat yang merupakan akta autentik wajib memenuhi syarat-syarat yakni subjektif maupun objektif. Akta wasiat merupakan suatu perjanjian. Dalam hal akta tersebut tidak memenuhi syarat objektif maka berakibat batal demi hukum. Apabila Notaris tidak dinyatakan bersalah dalam keterlibatannya dalam pembuatan akta maka pertimbangan hakim tidaklah tepat. Meskipun akta wasiat tersebut merupakan akta partij dimana Notaris tidak bertanggung jawab atas kebenaran isi dari akta tersebut, namun apabila melihat kewajiban Notaris maka Notaris harus saksama dalam melakukan perbuatan hukum. Tujuan penelitian dan penulisan tesis ini adalah untuk mengetahui kedudukan akta wasiat yang dibatalkan hakim dalam putusan pengadilan dan pertanggungjawaban notaris terhadap akta wasiat yang dibatalkan hakim dalam putusan pengadilan. Penelitian ini merupakan penelitian yuridis normatif yang menganalisa putusan pengadilan tinggi DKI Jakarta No. 805/PDT/2018/PT.DKI dengan menggunakan pendekatan UndangUndang, Pendekatan Kasus, dan Pendekatan Konseptual. Sumber data yang dipergunakan dalam penelitian ini adalah sumber data sekunder. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa berdasarkan Ketentuan KUHPerdata mengenai syarat sah suatu perjanjian harus memenuhi syarat objektif yaitu hal tertentu dan sebab yang halal, sehingga dapat disimpulkan terhadap Akta Wasiat yang diabatalkan Hakim tidak memenuhi syarat objektif yaitu sebab yang halal karena telang melanggar UndangUndang sehingga batal demi hukum.
