Abstract

Salah satu bentuk permohonan penetapan di pengadilan negeri adalah pengampuan. Pengampuan sendiri dilakukan terhadap seseorang yang dianggap tidak cakap secara hukum untuk melakukan perbuatan hukum sehingga perlu diwakili oleh orang lain. Namun dalam kenyataannya sering dijumpai kasus dimana seseorang yang masih cakap secara hukum diminta untuk ditetapkan pengampuan. Penelitian ini bertujuan untuk menjawab rumusan masalah dari penelitian ini, yaitu: (1) Bagaimana pengaturan pengampuan bagi seseorang yang dianggap tidak cakap secara hukum menurut KUHPerdata? (2) Bagaimana perlindungan hukum terhadap kurandus yang telah ditetapkan melalui penetapan pengadilan yang terbukti sehat dalam putusan 279 PK/Pdt/2019? Penelitian hukum ini menggunakan metode penelitian normatif, dengan menggunakan pendekatan peraturan perundang-undangan. Berdasarkan penelitian hukum yang telah dilakukan, dapat disimpulkan bahwa, dalam rumusan masalah pertama mengenai pengampuan telah diatur dalam KUHPerdata, namun masih belum diatur secara jelas, misalnya mengenai pengertian pengampuan itu sendiri. Sedangkan dalam rumusan masalah kedua, Perlindungan hukum bagi kurandus yang terbukti sehat dapat dilakukan melalui upaya hukum yang telah diatur dalam peraturan perundang-undangan yang berlaku./ One form of application for a determination in the district court is curatele. Curatele itself is carried out against someone who is considered legally incompetent to carry out legal actions so that it needs to be represented by other people. However, in reality, a case is often found where a person who is still legally capable is asked to be determined to be under custody. This study aims to answer the formulation of the problem from this research, namely: (1) How is the regulation of curatele for someone who is considered legally incompetent based on the Civil Code? (2) How is the legal protection for a curandus that has been determined through a court order that is proven healthy in verdict 279 PK/Pdt/2019? This legal research uses normative method, using a state approach. Based on legal research that has been done, it can be concluded that, in the formulation of the first problem regarding curatele has been regulated in the Civil Code, but vi tis still not clearly regulated, for example regarding the definition of curatele itself. Meanwhile, in the formulation of the second issue, Legal protection for a curandus who is proven healthy can be done through legal remedies that have been regulated in the applicable laws and regulations.
