The role of Notary today is has increase significantly due to the increasement of the needs of the community for its function to make authentic deeds. Due to the rapid development and the inclining standards of living, many people are looking for an easy alternative path to make a living, that is to do acts prohibited by legislation such as stealing. In the case of PT X, a limited liability company whose shares have been transferred by Notary A, by way of a deed of share sale and purchase, and deed of meeting decision without the fully signed document that are the basis for making such deeds. In the case of PT X, Notary A has committed an unlawful act in buying and selling shares, where in the share sale and purchase the must be checked in advance whether it requires approval from the company's organs first and if the sale and purchase results in the change of control, it must be announced in the daily news and stated in the deed Notary and to be upload to the AHU website. In essence, the Notary is only constituting the desire described by the clients into a deed in accordance with the laws and regulations. However, in the case of PT X, the Notary has shown to commit a violation of law that violates the Notary’s Code of Ethics and the Law of the Notary Title. So administratively from the Law of the Notary Title, the Notary will be examined by the Notary Supervisory Council and given punishment among others (i) verbal commentary; (ii) written reprimand; (iii) temporary suspension; (iv) resignation with respect or (v) dismissal with disrespect. / Peran Notaris dewasa ini semakin meningkat dengan semakin banyak kebutuhan oleh masyarakat atas fungsinya untuk membuat akta otentik. Sehubungan dengan perkembangan zaman yang cepat dan taraf hidup yang semakin tinggi, maka banyak orang yang mencari jalur alternatif yang mudah untuk hidup, yaitu melakukan perbuatan-perbuatan yang dilarang oleh peraturan perundang-undangan seperti mencuri. Dalam kasus PT X, sebuah perseroan terbatas yang sahamnya telah dialihkan oleh Notaris A, dengan cara membuat akta jual beli saham dan akta pernyataan keputusan rapat tanpa menggunakan dokumen dasar pembuatan akta yang ditandatangan lengkap. Dalam Kasus PT X Notaris A telah melakukan perbuatan melawan hukum dalam melakukan jual beli saham, dimana seharusnya dalam jual beli saham harus dilakukan pengecekan terlebih dahulu apakah memerlukan persetujuan dari organ perseroan terlebih dahulu dan jika mengakibatkan beralihnya pengendalian maka harus diumumkan dalam berita harian dan dituangkan dalam akta Notaris serta mengunggah ke situs AHU. Pada hakikatnya Notaris hanya mengkonstantir keinginan yang diterangkan oleh para penghadap ke dalam sebuah akta sesuai dengan peraturan perundang-undangan. Namun dalam kasus PT X, Notaris telah terbukti melakukan perbuatan melawan hukum yang jelas melanggar kode etik Notaris dan UUJN. Sehingga secara administratif dari UUJN, Notaris akan diperiksa oleh Majelis Pengawas Notaris dan diberi hukuman antara lain (i) teguran lisan; (ii) teguran tertulis; (iii) pemberhentian sementara; (iv) pemberhentian dengan hormat atau (v) pemberhentian dengan tidak hormat.
