Abstract

Kekerasan dalam rumah tangga seringkali terjadi dan disiarkan dalam media massa, sebagaimana diketahui rumah tangga seharusnya adalah tempat berlindung bagi seluruh anggota keluarga nyatanya justru merupakan tempat terjadinya kekerasan seksual. Kejahatan kesusilaan dan pelecehan seksual ini sudah begitu kompleks, meresahkan serta mencemaskan masyarakat sehingga tidak dapat dipandang dari sudut pandang mikro saja. Pelecehan seksual adalah penyalahgunaan hubungan perempuan dan laki-laki yang merugikan salah satu pihak (karena dilecehkan akan direndahkan mertabatnya) sedangkan kejahatan kesusilaan adalah suatu tindak pidana yang berhubungan dengan masalah kesusilaan dimana kesusilaan disini berkaitan dengan nafsu seksual atau perbuatan mengenai kehidupan seksual yang tidak senonoh serta dapat menyinggung rasa malu seksual seseorang atau sekelompok. Penelitian bertujuan untuk mengetahui ketepatan dalam penerapan RUU PKS kepada pelaku kekerasan dalam rumah tangga dibandingkan dengan KUHP dan UU KDRT. Tipe penelitian adalah yuridis normatif dan pendekatan masalah menggunakan Statute Approach dan Doktrinal Approach. Jawaban atas rumusan masalah perihal substansi Pasal-pasal untuk tindak pidana kekerasan seksual, dengan meneliti dua macam Ius Constitutum yakni KUHP dan UU KDRT serta Ius Constituendum yakni RUU PKS dapat disimpulkan Ius Constituendum berupa RUU PKS lebih lengkap dan rinci dalam hal mengatur kekerasan seksual secara umum dan tidak terbatas sebagai kekerasan seksual dalam rumah tangga / Domestic violence often occurs and is broadcast in the mass media, as is well known that households should be a shelter for all family members, in fact it is actually a place of sexual violence. This crime of decency and sexual harassment has become so complex, unsettling and worrying about the community that it cannot be viewed from a micro perspective only. Sexual harassment is the misuse of relations between women and men which harms one of the parties (because being harassed will be demeaned by his relatives) while decency is a criminal offense related to decency issues where decency here is related to sexual lust or sexual immoral conduct and can offend someone or a group of sexual shame. The study aims to determine the accuracy in the application of the RUU PKS to perpetrators of domestic violence compared to the Criminal Code and the Domestic Violence Law. The type of research is normative juridical and problem approach using Statute Approach and Doctrinal Approach. The answer to the formulation of the problem regarding the substance of the articles for criminal acts of sexual violence, by examining two kinds of Ius Constitutum namely the Criminal Code and the Domestic Violence Act and the Ius Constituendum namely the RUU PKS can be concluded Ius Constituendum in the form of the RUU PKS more complete and detailed in terms of regulating sexual violence in general and is not limited to sexual violence in the household
