Abstract

Penelitian ini bertujuan untuk mengetahui apa langkah perlindungan hukum terhadap konsumen atas makanan dan minuman kedaluwarsa. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan statue approach dan conceptual approach. Faktor yang menyebabkan pelaku usaha mengedarkan makanan kedaluwarsa adalah karena ketidaktahuan mereka bahwa menjual makanan kedaluwarsa merupakan pelanggaran hukum dan dikenakan sanksi pidana. Selain itu konsumen enggan untuk komplain atas perbuatan pelaku usaha tersebut dikarenakan konsumen merasa hanya buang waktu, tenaga serta materi jika melaporkan ke pihak terkait. Hasil penelitian menunjukkan bahwa penerapan undang-undang perlindungan konsumen belum terlaksana secara optimal di mana pelaku usaha belum sepenuhnya memperhatikan kewajibannya dan pihak konsumen belum mengetahui akan hak-hak yang dimilikinya. Oleh karenanya sangat diperlukan pembinaan kepada pelaku usaha dan pendidikan kepada konsumen serta pengawasan dari Pemerintah terhadap peredaran produk pangan di toko-toko tradisional, minimarket dan supermarket secara berkala. Undang Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen menjelaskan bahwa konsumen berhak atas kenyamanan, keamanan, dan keselamatan dalam mengonsumsi barang dan jasa. Perlindungan terhadap konsumen harus menjadi perhatian yang serius oleh pemerintah khususnya pada produk pangan yang beredar di lingkungan masayarakat, sehingga para konsumen tidak menjadi korban para produsen yang tidak bertanggungjawab./This study aims to find out what legal protection steps are for consumers for expired food and drinks. This study uses a normative juridical research method with a statue approach and a conceptual approach. The factor that causes business actors to distribute expired food is due to their ignorance that selling expired food is a violation of the law and subject to criminal sanctions. In addition, consumers are reluctant to complain about the actions of these business actors because consumers feel that it is only a waste of time, energy and material if reporting to related parties. The results of the study show that the application of consumer protection laws has not been implemented optimally where business actors have not fully paid attention to their obligations and consumers have not known about their rights. Therefore, there is a great need for guidance for business actors and education for consumers as well as supervision from the Government on the distribution of food products in traditional shops, mini-markets and supermarkets on a regular basis. Law Number 8 of 1999 concerning Consumer Protection explains that consumers have the right to comfort, security and safety in consuming goods and services. Protection of consumers must be a serious concern by the government, especially for food products circulating in the community, so that consumers do not become victims of irresponsible producers.
