The Tobacco Products Industry is an industry that until now has become a polemic in Indonesian society. On the first hand, this industry has a very large role in improving the economy and adding economic value nationally, through state revenues in the form of excise and taxes. But on the other hand, this industry has a very bad impact when referring to the health side of the community, also the surrounding environment. Indonesia, as one of the countries with the largest cigarette consumption and production in the world, is the only country in Southeast Asia that has not ratified the FCTC. The World Health Organization (WHO) established an international organization, FCTC, in order to work on the impacts of multinational tobacco circulation control. Therefore, there is a formulation of the problem, related to how the factors and polemics that affected the legal process related to the rejection of the ratification of the FCTC by the Government of Indonesia, as well as how is the alignment and comparison between the laws and regulations in Indonesia and the provisions in the FCTC. The research type used is normative legal research with a legal approach methodology to laws and regulations. Based on the results of research in this thesis, Indonesian government chose not to participate in the FCTC because of its own national interests, such as state revenue interests, labor interests and cultural and historical interests. However, although not ratifying the FCTC, the Government actually has already had a draft law relating to tobacco regulation regulatory products and legal arrangements that are in accordance with several provisions in the FCTC such as labeling, advertising, sponsorship and promotion, nicotine and tar content formulated by the Government in legal and regulatory products related to tobacco control.
