Abstract

This study aims to determine how the legal protection that was given by the judge to the victim of sexual harassment in case Number 46/Pid.B/2022/PN Pbr and aims to find out what form of legal protection will be given to the victims of sexual harassment cases. The research method used in this study uses normative juridical research by analyzing problems through positive law and court decision. The data used consist of primary legal materials, secondary legal materials, and tertiary legal materials. The data collected uses qualitative research analysis techniques with a descriptive character that focuses to the problems in this research study. The results of this study indicate that the judge did not contribute legal protection to the victim of sexual harassment in his verdict in the case Number 46/Pid.B/2022/PN Pbr. According to the judge, there was a weakness in the evidence in this case because there was only one witness, which is the victim herself. Another weakness is because the is an unclear regulation in the Indonesian Penal Code and its evidentiary law. The sexual harassment case in the case used the regulations of Sexual Violence in Indonesian Penal Code (KUHP) which has a legal vacuum therefore, the judge should be able to create jurisprudence to protect the victim due the legal vacuum. It is to prevent sexual harassment attempts that occur continuously in the education institutions. Legal protection for victims of sexual harassment is regulated in the Law of Sexual Violence Crimes which comprehensively provides protection to victims of sexual harassment in granting their rights and crime sentences against perpetrators of sexual crimes hereafter. / Penulisan ini bertujuan untuk mengetahui bagaimana perlindungan hukum yang diberikan oleh hakim kepada korban pelecehan seksual dalam perkara Nomor 46/Pid.B/2022/PN Pbr serta memiliki tujuan untuk mengetahui bagaimana bentuk perlindungan hukum yang akan diberi kepada korban dari permasalahan pelecehan seksual. Metode Penelitian yang digunakan dalam penelitian ini menggunakan penlitian yang bersifat yuridis normatif yaitu dengan melakukan analisis pada permasalahan melalui hukum positif dan putusan pengadilan. Sumber data yang digunakan terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Penulis mengumpulkan data menggunakan teknik analisis metode penelitian kualitatif yang memiliki sifat deskriptif yang berfokus kepada mendapatkan jawaban mengenai permasalahan dalam penelitian ini. Hasil penelitian ini menunjukkan bahwa hakim tidak memberikan perlindungan hukum kepada Korban pelecehan seksual pada putusan Nomor 46/Pid.B/2022/PN Pbr. Hakim mengatakan bahwa ada kelemahan pada pembuktian dalam kasus ini karena hanya ada satu saksi yaitu korban itu sendiri. Hambatan lain dalam menangani kasus ini karena adanya peraturan yang tidak jelas dalam KUHP dan dalam pembuktiannya. Kasus pelecehan seksual ini masih menggunakan peraturan pada KUHP sehingga memiliki kekosongan hukum yang seharusnya hakim dapat menggunakan yurisprudensi (jurisprundence) untuk melindungi korban. Hal tersebut bertujuan untuk mencegah pelecehan seksual terjadi lagi pada ruang lingkup pendidikan. Perlindungan hukum terhadap korban pelecehan diatur dalam UU TPKS yang secara komprehensif memberikan perlindungan kepada korban pelecehan seksual dalam memberikan haknya dan juga sanksi pidana terhadap pelaku kejahatan seksual kedepannya.
