Abstract

Kawasan Ekonomi Khusus Mandalika adalah salah satu kawasan yang diprioritaskan pemerintah untuk dilakukannya pembangunan. Dikarenakan pembangunan infrastruktur di kawasan tersebut membutuhkan tanah yang luas, maka diperlukan juga tanah milik masyarakat untuk melanjutkan kegiatan pembangunan. Agar tanah tersebut dapat digunakan, maka dilakukan pembebasan tanah terlebih dahulu. Untuk pengadaan tanah di Kawasan Ekonomi Khusus Mandalika mengikuti ketentuan yang diatur dalam Undang-Undang Nomor 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum. Dalam penelitian ini digunakan penelitian hukum yuridis normatif karena penulis mengkaji pelaksanaan pengadaan tanah di Kawasan Ekonomi Khusus Mandalika dengan menggunakan pendekatan Undang-Undang (statute approach). Metode dan teknik pengumpulan data dilakukan dengan studi kepustakaan dan wawancara dengan instansi-instansi yang terkait. Dari hasil penelitian tersebut dapat disimpulkan pelaksanaan tanah di Kawasan Ekonomi Khusus Mandalika sesuai dengan prosedur yang di tetapkan dalam peraturan perundangan, akan tetapi terdapat hambatan dalam pelaksanaannya antara lain adanya pemegang hak atas tanah yang tidak mau menyerahkan tanahnya, adanya perbedaan pendapat serta keinginan mengenai jumlah ganti kerugian yang diberikan, keinginan pemegang hak atas tanah untuk digantikan dengan tanah yang lain. Adapun upaya untuk mengatasi hambatan tersebut adalah memprioritaskan musyawarah, melakukan mediasi dan pendekatan secara persuasif, melakukan sosialisasi, dan memberikan ganti rugi non-fisik kepada pemegang hak atas tanah. / Mandalika's Special Economic Zone is one of areas that Government prioritizes for development. Because infrastructure development in that area requires extensive land, it is also necessary land owned by the community to continue development activities. Land owned by the community is affected by development activities so land acquisition needs to be done first. To procure land in Mandalika Special Economic Zone, follow the provisions stipulated in Law No. 2 of 2012 concerning Land Procurement for Development in the Public Interest. In this research, normative juridical legal research is used because the author examines the implementation of land acquisition in the Mandalika Special Economic Zone by using a statute approach. The methods and techniques of data collection are carried out by library studies and interviews with relevant agencies. From the results of this study, it can be concluded that the implementation of land in the Mandalika Special Economic Zone is in accordance with the procedures stipulated in legislation, but there are obstacles in its implementation, including the existence of holders of land rights who do not want to surrender their land, differences of opinion and wishes about the amount losses given, the wishes of the holders of land rights to be replaced with other land. The efforts to overcome these obstacles are prioritizing deliberation, mediating and persuasive approaches, conducting socialization, and providing non-physical compensation to holders of land rights.
