Abstract

Perjanjian perkawinan (Posnuptial Agreement) merupakan salah satu bentuk perlindungan hukum bagi Warga Negara. Akibat hukum lainnya setelah terjadinya perkawinan adalah percampuran harta benda. Peran Notaris sebagai pejabat publik yang membuat Akta Autentik sangat penting perannya di dalam hal ini karena berdasarkan Pasal 15 UUJN Notaris berwenang untuk memberikan penyuluhan hukum kepada masyarakat dalam pembuatan akata autentuk, salah satunya pembuatan Akta Perjanjian Kawin sebagai sarana perlindungan hukum terhadap hak masyarakat.Penelitian ini menggunakan penelitian hukum normatif. Penelitian hukum normatif adalah kajian hukum sebagai suatu sistem peraturan-peraturan yang abstrak, termasuk asas-asasnya. Jenis data yang digunakan dalam penulisan hukum ini adalah data sekunder. Penelitian ini menggunakan teknik pengumpulan data, yaitu penelitian kepustakaan (library research). Penelitian ini menggunakan metode kualitatif. Analisis data dalam peneltian ini adalah Kualitatif Deskriptif.Pasal 15 UUJN mencantumkan bahwa Notaris berwenang melakukan penyuluhan hukum terhadap masyarakat. Setelah Putusan Mahkamah Konstitusi No. 69/2015, perjanjian perkawinan dapat dibuat setelah perkawinan (postnuptial agreement), Penetapan Mahkamah Agung Nomor 303/Pdt.P/2021/PA.Smdg merupakan implementasi Putusan MK. Perjanjian Kawin dalam perkawinan campuran dapat melindungi Hak atas tanah, berdasarkan Pasal 21 ayat 1 UUPA bahwa hanya WNI yang dapat memiliki hak milik atas tanah, media yang dapat melindungi WNI tersebut adalah perjanjian kawin yang dibuat dihadapan Notaris. / Marriage agreement (Posnuptial Agreement) is one form of legal protection for citizens. Another legal consequence after the occurrence of marriage is the mixing of property. The role of Notary as a public official who makes authentic deeds is very important in this case because based on Article 15 of the UUJN Notary is authorized to provide legal counseling to the public in making authentic deeds, one of which is the making of a Marriage Agreement Deed as a means of legal protection of community rights.This research uses normative legal research. Normative legal research is a study of law as a system of abstract rules, including its principles. The type of data used in this legal writing is secondary data. This research uses data collection techniques, namely library research. This research uses a qualitative method. Data analysis in this research is Descriptive Qualitative. Article 15 of the UUJN states that Notaries are authorized to conduct legal counseling to the public. After the Constitutional Court Decision No. 69/2015, a marriage agreement can be made after marriage (postnuptial agreement), the Supreme Court Determination Number 303/Pdt.P/2021/PA.Smdg is the implementation of the Constitutional Court Decision. Marital Agreements in mixed marriages can protect land rights, based on Article 21 paragraph 1 of the UUPA that only citizens can have property rights to land, the media that can protect these citizens is a marriage agreement made before a Notary.
