The world of digital-based trade transactions is a new breakthrough in the business world, where the relationship between consumers and business actors moves from conventional to electronic-based. The development of the digital economy has a positive impact on the business world but on the other hand has the tendency to create legal problems in the aspect of legal protection for. Gofood as one of the services in the Gojek application is one of the new breakthroughs in the world of digital or electronic-based trading business that provides services for buying and delivering food or drinks to consumers. This service is quite widely used by most Indonesian people, where people as consumers are given the convenience to enjoy a food or beverage product without making orders directly to a restaurant, but only by ordering via smartphone consumers can get food / drinks as desired. The problem that arises from this service is that the price listed in the application turns out to be different from the actual price. This writing discusses the regulation of trade transactions through application applications in the perspective of national law and the protection of application users in Law Number 8 of 1999 concerning Consumer Protection. From the problems in this paper, the authors conclude that trade transactions through the Gojek application in the gofood service have not fulfilled the provisions of the Civil Code and Information and Electronic Transactions Law relating to the legal terms of the agreement or electronic contract, where the a lawful cause because of misleading information about the price of goods which becomes a prohibition in the Consumer Protection Act. There has been a violation of Article 10 of the Consumer Protection Law regarding misleading information on prices of goods. So from that consumers and non-governmental organizations to take efforts and legal mechanisms that have been regulated in consumer protection laws. / Dunia transaksi perdagangan berbasis digital merupakan suatu terobosan baru dalam dunia usaha, dimana hubungan antara konsumen dan pelaku usaha bergerak dari konvensional menjadi ke arah yang berbasis elektronik. Perkembangan ekonomi digital memberikan dampak positif bagi dunia usaha namun disisi yang lain bertendensi menimbulkan permasalahan hukum dalam aspek perlindungan hukum bagi . Gofood sebagai salah satu layanan dalam aplikasi gojek merupakan salah satu terobosan baru dalam dunia usaha perdagangan yang berbasis digital/ elektonik yang memberikan pelayanan pembelian serta pengantaran makanan/minuman bagi konsumen. Layanan ini cukup banyak digunakan oleh sebagian besar masyarakat Indonesia, dimana masyarakat sebagai konsumen diberikan kemudahan untuk menikmati suatu produk makanan/minuman tanpa melakukan pesanan secara langsung ke suatu restoran, namun hanya dengan melakukan order melalui smartphone konsumen dapat mendapatkan makanan/minuman sesuai yang dikehendaki. Masalah yang timbul dari layanan ini adalah harga yang dicantumkan dalam aplikasi ternyata berbeda dengan harga yang sebenarnya. Penulisan ini membahas tentang pengaturan mengenai transaksi perdagangan melalui aplikasi gojrk dalam perspektif hukum nasional dan perlindungan pengguna aplikasi dalam UndangUndang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Dari permasalahan dalam penulisan ini, penulis berksimpulan bahwa transaksi perdagangan melalui aplikasi gojek dalam layanan gofood belum memenuhi ketentuan Kitab UndangUndang Hukum Perdata dan Undang- Undang Informasi dan Transaksi elektronik yang berkaitan dengan syarat sahnya perjanjian dan/ atau kontrak elektronik, dimana tidak terpenuhinya unsur suatu sebab yang halal karena adanya informasi yang menyesatkan mengenai harga barang yang menjadi suatu larangan dalam UndangUndang Perlindungan Konsumen. Telah terjadi pelanggaran atas pasal 10 UndangUndang Perlindungan Konsumen mengenai informasi harga barang yang menyesatkan. Maka dari itu lembaga swadaya masyarakat perlu untuk membina konsumen untuk mensosialisasikan hak-hak konsumen serta menempuh upaya hukum atas pelanggaran teresbut sesuai dengan Undang- Undang perlindungan konsumen.
