Abstract

Consumer protection aims to provide benefits, justice, balance and legal certainty to consumers, so that all actions befireen business actors and consumers are given limitations, by rights and obligations and prohibitions as stipulated in Law Number I of 1999 concerning the Protection of Consumer. At present, there are still acts by business actors which violates the Provisions of the Consumer Protection act, such as selling apartment units to consumers, which do not have complete licensing for the construction of apartments and do not provide true, clear and honest information to consurrers regarding the status of the apartments. The author shall discuss the responsibilities of businesses in offering aparknent units to consumers and the implementation of business responsibilities of selling apartment units in case Nomor :92/Pdt.G/2017/PN.Jld.Sel. Normative legal research using a legal approach, case approach and concepfual approach. The result of this research are that business actors must provide true, clem and honest information to consumers, therefore provides legal certainty to consumers who bind themselves to business actors. Implementation of business actors' responsibility over selling apaftment units in case Nomor :92/Pdt.G/2017/PN.Jld.Sel. in November 16, 2017, is that the action of business actors did not provide true, clear and honest information. tn addition, the case decision did not consider the absence of complete licensing of apartrnent construction, allowing other business actors to override licensing but prioritizing inforrnation that only made consumers interested in offering apartrnent units. / Perlindungan Konsumen bertujuan untuk memberikan manfaat, keadilan, keseimbangan serta kepastian hukum kepada konsumen, sehingga segala perbuatan pelaku usaha dengan konsumen diberikan batasan - batasan, baik hak maupun kewajiban, larangan - larangan, sebagaimana yang diatur dalam Undang - Undang Nomor 8 Tahun 7999 tentangPerlindungan Konsumen. Pada saat ini masih ada perbuatan pelaku usaha yang melanggar ketentuan Undang - Undang Perlindungan Konsumen, seperti melakukan penjualan unit apartemen kepada konsumen, namun belum rnemiliki perizinan yang lengkap untuk pembangunan apartemen dan tidak memberikan informasi yaog benar, jelas dan jujur kepada konsumen mengenai status dari apartemen tersebut. Penulis membahas mengenai tanggung jawab pelaku usaha dalam metawarkan unit apartemen kepada konsumen dan bagaimana implementasi tanggung jawab pelaku usaha dalam penjualan unit apartemen dalam perkara Nomor :92tP dt.G 120 I 7/PN.Jkt. Sel, tertanggal 1 6 November 2Al7 . Penelitian hukum normatif dengan rnenggunakan pendekatan perundang undangan, pendekatan kasus dan pendekatan konseptual. Hasil dari penelitiap, adalah bahwa Pelaku Usaha yang harus memberikan informasi yang benar, jelas dan jujur kepada Konsumen, sehingga memberikan kepastian hukum kepada konsumen yang mengikatkan diri kepada pelaku usaha. Implementasi tanggrrng jawab pelaku usaha atas penjualan unit apartemen dalam perkara Nomor: 92/Pdt.Gl20l7l?N.Jkt.Sel, tertanggal 16 November 2eir7 anahhperbuatan Pelaku Usaha tidak memberikan informasi yang benar, jelas dan jujur. Selain itq Putusan perkaratersebut tidak mempertimbangkan mengenai belum adarryaperizinan yang lengkap terhadap pembangunan apartemen, sehingga memungkinkan pelaku usaha lain untuk mengesampingkan mengenai perizinan tetapi lebih mengutamakan informasi yang hanya membuat konsumen tertarik dalam menawarkan unit apartemen.
