Portrait is one of photographic artworks that places humans as objects, both individually and in groups. According to Article 1 (10) of Law No. 28 of 2014 on Copyright, portrait is a photographic work with human objects. In terms of the use of portraits for commercial purposes, the Copyright Law requires prior written consent from the person being photographed. In practice, in the digital era, especially in social media, there have been a lot of portrait copyright violations. The research method used is normative legal research, by reviewing relevant regulations. Besides that, empirically, there are still many violations of a portrait which are caused by lack of understanding of Intellectual Property Rights, especially Copyright. Many cases have come its way in the form of distributing portrait on social media without consent from the creator's and the subject being portrayed. From the results of this research, it can be concluded that the regulation regarding portraits and the implementation as regulated in Law No. 28 of 2014 on Copyright, not yet able to fully provide legal protection for creators or social media users. Implementation of legal protection of copyright on portrait in social media needs to be supported by socialization and education of legal understanding and awareness from the society itself. / Potret adalah salah satu karya seni fotografi yang menempatkan manusia sebagai objek, baik secara individual maupun kelompok. Menurut Pasal 1 Angka 10 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, potret adalah karya fotografi dengan objek manusia. Dalam hal penggunaan potret untuk kepentingan komersial, Undang-Undang Hak Cipta mengharuskan adanya persetujuan tertulis terlebih dahulu dari orang yang dipotret. Dalam prakteknya, di era digital terutama di media sosial banyak sekali ditemukan pelanggaran hak cipta potret. Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu mengkaji peraturan yang relevan. Selain itu juga yuridis empiris, dengan temuannya masih banyak pelanggaran terhadap suatu karya cipta potret yang penyebabya tentunya karena kurangnya pemhamahan terhadap hukum Hak Kekayaan Intelektual khususnya Hak Cipta. Kasus pelanggaran terutama terjadi dalam bentuk penyebarluasan potret di media sosial tanpa seizin pencipta dan subjek yang di potret. Dari hasil penelitian tersebut, dapat disimpulkan bahwa pengaturan mengenai potret dan pelaksanaannya yang diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, belum dapat sepenuhnya menjamin perlindungan hukum bagi pencipta ataupun pengguna media sosial. Implementasi pengaturan perlindungan hak cipta potret di media sosial perlu didukung sosialisasi dan edukasi terhadap pemahaman dan kesadaran hukum di masyarakat.
