Abstract

CEDAW sebagai konvensi internasional yang fokus dalam penghapusan segala bentuk diskriminasi terhadap perempuan telah diratifikasi Indonesia sejak tahun 1984 silam dan prinsipnya telah dituangkan dalam peraturan perundang-undangan. Seiring berkembangnya zaman terutama teknologi yang semakin maju, bentuk kekerasan juga mulai berkembang dan terjadi di platform digital yang kini dikenal dengan Kekerasan Berbasis Gender Online (KBGO) yang difasilitasi oleh teknologi dan mengalami peningkatan pesat semenjak periode Pandemi Covid-19. Penelitian ini hendak menganalisis implementasi prinsip-prinsip CEDAW dalam berbagai regulasi yang berlaku di Indonesia dalam upaya untuk mengatasi isu KBGO guna untuk mengetahui gambaran struktur penghapusan KBGO di Indonesia. Implementasi CEDAW dalam penanggulangan KBGO dalam hal ini dilihat dengan menggunakan perspektif dari Feminisme Liberal serta berbagai konsep Hubungan Internasional yang terkait. Pendekatan penelitian yang diaplikasikan yaitu kualitatif dengan metode penelitian studi kasus. Data sekunder yang diperoleh kemudian dianalisis dan menghasilkan temuan bahwa walaupun prinsip-prinsip CEDAW telah tertuang dalam berbagai peraturan perundang-undangan, namun tidak ada satu pun yang menyebutkan secara eksplisit mengenai definisi, bentuk, pencegahan maupun penanggulangan KBGO. Adapun CEDAW sebagai konvensi internasional tidak memiliki hak untuk ikut campur dalam penanganan langsung ataupun pembuatan kebijakan karena tidak memegang prinsip intervensi negara. Dengan ini, pemerintah sebagai pembuat kebijakan perlu untuk melakukan pembaharuan regulasi dengan membuat atau menambahkan poin mengenai KBGO dalam peraturan perundang-undangan yang berlaku. / CEDAW as an international convention that focuses on eliminating all forms of discrimination against women has been ratified by Indonesia since 1984 and its principles have been outlined in legislation. Along with the development of the times, especially advanced technology, forms of violence have also begun to develop and occur on digital platforms, now known as Online Gender-Based Violence (OGBV) which is facilitated by technology and has increased rapidly since the Covid-19 Pandemic period. This research aims to analyse the implementation of CEDAW principles in various applicable regulations in Indonesia in an effort to address the issue of OGBV in order to find out the structure of the elimination of OGBV in Indonesia. The implementation of CEDAW in tackling OGBV in this case is seen using the perspective of Liberal Feminism and various related International Relations concepts. The research approach applied is qualitative with a case study research method. The secondary data obtained was then analysed and resulted in the finding that although the principles of CEDAW have been contained in various laws and regulations, none of them explicitly mention the definition, form, prevention or prevention of OGBV. The CEDAW as an international convention does not have the right to interfere in direct handling or policy making because it does not hold the principle of state intervention. With this, the government as a policy maker needs to update regulations by creating or adding points regarding OGBV in the applicable laws and regulations.
