Abstract

Dengan maraknya minat konsumen terhadap Industri perawatan tubuh/wajah (skin care) di Indonesia terus berkembang. Pertumbuhannya telah mencapai 6% dan diprediksi akan terus bertumbuh seiring dengan tingginya kepedulian wanita Indonesia dalam merawat kulitnya. Berbagai perawatan dilakukan oleh institusi kecantikan, terlebih bagi salon kecantikan yang sering melakukan berbagai contoh perawatan yang berada diluar kewenangannya sepertu Office-based, minimally invasive procedures yang berguna untuk peremajaan kulit wajah seperti operasi lipatan mata, peninggian hidung dan injeksi Filler, chemical peeling atau Botulinum Toxin (BoNT/Botox) dan lain-lain. Dalam mengantisipasi potensi kerugian yang dikemudian hari, salon kecantikan turut melampirkan surat persetujuan perawatan yang dipergunakan selayaknya Informed Consent atau surat persetujuan tindakan kedokteran sesuai dengan Menteri Kesehatan No. 290 Tahun 2008 tentang Persetujuan Tindakan Kedokteran. Pengaturan mengenai perizinan salon di Indonesia masih dapat dianggap kurang tegas untuk membatasi kewenangan dan penerapan sanksi ganti rugi. Oleh karena itu penelitian ini bertujuan untuk memberikan analisis terhadap pengaturan penyelenggaraan salon kecantikan menurut peraturan perundang-undangan dan perlindungan hukum bagi konsumen yang menggunakan jasa perawatan di salon kecantikan. Berdasarkan penelitian ini dapat disimpulkan bahwa terdapat banyak pelanggaran wewenang yang dilakukan oleh salon kecantikan yang diantaranya penggunaan informed consent yang dipergunakan selayaknya surat persetujuann tindakan kedokteran, pelanggaran terhadap kewenangan salon yang tidak sesuai Peraturan Dirjen Bina Gizi dan Kesehatan Ibu dan Anak Np. HK.01.01/BI.4/4051/2011 tentang Pedoman Penyelenggaraan Salon Kecantikan. Perlindungan hukum terhadap konsumen salon yaitu sesuai dengan ketentuan dalam Undang-undang Perlindungan Konsumen No. 8 Tahun 1999 Tentang Perlindungan Konsumen, kemudian apabila konsumen menderita kerugian terhadap pengenaan informed consent yang tidak diatur secara signifikan dalam Pedoman Penyelenggaraan Salon maka berlaku perlindungan hukum terhadap Perbuatan Melawan Hukum dalam pasal 1365 KUHPerdata. / With the rise of consumer interest in the body / face care industry (skin care) in Indonesia continues to grow. Its growth has reached 6% and is predicted to continue to grow along with the high concern of Indonesian women in caring for their skin. Various treatments are carried out by beauty institutions, especially for beauty salons who often perform various examples of treatments that are beyond their authority such as Office-based, minimally invasive procedures that are useful for facial skin rejuvenation such as eye fold surgery, nasal elevation and injection fillers, chemical peels or botulinum Toxin (BoNT / Botox) and others. In anticipating the potential loss in the future, the beauty salon also attaches a treatment approval letter which is used as an Informed Consent or medical action approval letter in accordance with the Minister of Health No. 290 of 2008 concerning approval of medical measures. egulations regarding salon licenses in Indonesia can still be considered less strict to limit the authority and application of sanctions of beauty salon for compensation. Therefore this study aims to provide an analysis of the organization of beauty salons according to statutory regulations and legal protection for consumers who use care services in beauty salons. Based on this study it can be concluded that there are many violations of authority by beauty salons, including the use of informed consent that is used as a medical action approval letter, violation of salon authority that is not in accordance with the Regulation of the Peraturan Dirjen Bina Gizi dan Kesehatan Ibu dan Anak Np. HK.01.01/BI.4/4051/2011 tentang Pedoman Penyelenggaraan Salon Kecantikan (guidelines of beauty salon). Legal protection for salon consumers that is in accordance with the provisions in the Consumer Protection Act No. 8 of 1999 concerning Consumer Protection, then if the consumer suffers a loss from the imposition of informed consent that is not significantly regulated in the Salon Implementation Guidelines, then the legal protection of Unlawful Acts in article 1365 of the Civil Code.
