Abstract
Fair use adalah prinsip hukum yang mengatur penggunaan karya berhak cipta tanpa izin, yang menciptakan ruang untuk kepentingan publik, sementara komersialisasi adalah transformasi produk atau layanan menjadi komoditas untuk
mendapatkan keuntungan finansial. Lisensi adalah elemen kunci dalam mengelola penggunaan karya berhak cipta. Dalam perjanjian lisensi, izin resmi diberikan kepada pihak lain untuk menggunakan karya dengan ketentuan yang ditentukan, termasuk pembayaran royalti. Royalti adalah kompensasi yang diberikan kepada pemilik hak cipta atau pemegang lisensi sebagai imbalan atas penggunaan atau eksploitasi karya tersebut. Tugas Akhir ini bertujuan untuk mengetahui sejauh mana konsep fair use berlaku untuk penggunaan lagu berhak cipta dalam layanan keagamaan secara live streaming di YouTube. Hasil analisis dalam Tugas Akhir ini menunjukkan bahwa menampilkan iklan pada saat live streaming ibadah di YouTube dianggap sebagai bentuk komersialisasi karena iklan tersebut dapat menghasilkan keuntungan finansial bagi pengguna. Tugas Akhir ini memberikan panduan praktis bagi gereja sebagai pemilik channel YouTube dalam menjalankan aktivitas online mereka dengan mempertimbangkan kebijakan hak cipta dan pertimbangan moral. Melalui Tugas Akhir ini dapat disimpulkan bahwa penggunaan karya yang dimaksudkan untuk mendapatkan keuntungan secara ekonomis dan tanpa seizin pencipta termasuk dalam pelanggaran hak cipta.

Fair use is a legal principle that governs the use of copyrighted works without permission, creating a space for public interest, while commercialization is the transformation of products or services into commodities for financial gain. Licensing is a key element in managing the use of copyrighted works. In a licensing agreement, official permission is granted to another party to use the work under specified conditions, including royalty payments. Royalty is compensation given to the copyright owner or licensee in return for the use or exploitation of the work. This Final Project aims to determine the extent to which the concept of fair use applies to the use of copyrighted songs in religious services through live streaming on YouTube. The analysis in this Final Project shows that displaying ads during live streaming of religious services on YouTube is considered a form of commercialization because these ads can generate financial profits for the user. This Final Project provides practical guidance for churches as YouTube channel owners in conducting their online activities, taking into account copyright policies and moral considerations. Through this Final Project, it can be concluded that using works intended for economic gain without the creator's permission constitutes a copyright infringement.
