Abstract

The development of technology, conventional trading today began to shift using the internet, then known as electronic commerce (e-commerce) which still has a legal basis for trading or buying and selling ordinary. An estimated 3.6 billion people on earth will access the internet at least once every month. With the use of the internet more and more, the public also makes buying and selling transactions using the internet by 11.33% accessing the internet for shopping. The problem that arises in e-commerce is proof in electronic sale and purchase transactions that use electronic signatures and legal protection for buyers who use electronic agreements. The approach in studying the problems that arise is using juridical normative that uses legal material in the form of laws, related books and relevant legal journals. Based on an analysis of the existing problems that result from the decision of the Constitutional Court regarding "Electronic Information and / or Electronic Documents. Following the content of the petition in the Constitutional Court, the verdict leads to the criminal legal process and not the civil legal process. So it is necessary to expand the meaning of the Civil Code, the Copyright Act, the Consumer Protection Act, the Electronic Technology Information Act and the Trademark Law related to it. So that the researcher gives a suggestion There is a need for regulation regarding the evidence submitted by one of the parties to the court that uses an electrical agreement, to create legal certainty for both Parties. So it is necessary to expand the meaning of transactions made through the internet, so the implications for transactions made through the internet can get legal certainty. / Berkembangnya teknologi, perdagangan yang konvensional dewasa ini mulai bergeser menggunakan internet, kemudian dikenal sebagai electronic commerce (e-commerce) yang pada dasarnya tetap memiliki dasar hukum perdagangan atau jual beli biasa. Diperkirakan sebanyak 3,6 miliar manusia di bumi bakal mengakses internet setidaknya sekali tiap satu bulan. Dengan penggunaan internet yang semakin banyak, masyarakat pun melakukan transaksi jual beli menggunakan internet sebesar 11.33% mengakses internet untuk keperluan belanja. Permasalahan yang timbul dalam e-commerce ialah pembuktian dalam transaksi jual beli secara elektronik yang menggunakan tanda tangan elektronik dan perlindungan hukum bagi para pembeli yang menggunakan perjanjian secara elektronik. Pendekatan dalam mengkaji permasalah yang ditimbul menggunakan normatif yuridis yang menggunakan bahan hukum berupa undang-undang, buku-buku yang terkait serta jurnal-jurnal hukum yang relevan. Berdasarkan analisis atas permasalahan yang ada bahwa akibat dari putusan Mahkamah Konstitusi mengenai “Informasi Elektronik dan/atau Dokumen Elektronik Sesuai dengan materi muatan permohonan pada Mahkamah Konstitusi maka amar putusan tersebut mengarah pada proses hukum pidana dan bukan proses hukum perdata. Sehingga perlu dilakukan perluasan makna dari KUH Perdata, Undang-Undang Hak Cipta, Undang-Undang Perlindungan Konsumen, Undang-undang Informasi Teknologi Elektronik dan Undang-Undang Merek terkait dengan hal tersebut. Sehingga peneliti memberikan saran perlu adanya pengaturan mengenai alat bukti yang di ajukan oleh salah satu pihak kepada pengadilan yang menggunakan perjanjian elektroik, agar terciptanya kepastian hukum terhadap kedua belah Pihak. Sehingga perlu adanya perluasan makna terhadap transaksi yang dilakukan melalui internet, sehingga implikasi terhadap transaksi yang dilakukan melalui internet dapat mendapatkan kepastian hukum.
