Abstract

Kepailitan merupakan suatu cara penyelesaian yang bersifat komersial dengan tujuan untuk terbebas dari persoalan utang piutang yang menghimpit seorang Debitor ketika Debitor tidak lagi memiliki kemampuan untuk melunasi utang-utang tersebut kepada Kreditornya. Selain penyelesaian melalui Kepailitan, Debitor dapat mengajukan penundaan kewajiban pembayaran utang (PKPU) ke pengadilan niaga dengan tujuan untuk mengajukan rencana perdamaian yang meliputi pembayaran seluruh atau sebagian utangnya kepada para kreditornya, agar tidak terjadi kepailitan. Kreditor-Kreditor yang mengajukan tagihan akan diklasifikasikan ke dalam 3 (tiga) jenis Kreditor, berdasarkan penjelasan pada Pasal 2 ayat (1) UUK-PKPU dalam hal ini adalah Kreditor konkuren, Kreditor separatis, dan Kreditor preferen. Kreditor separatis merupakan seorang Kreditor pemegang hak jaminan kebendaan atas piutangnya. Penelitian ini didasarkan terhdap putusan perdamaian Nomor 376/Pdt.Sus-PKPU/2021/PN Niaga Jkt.Pst jo. 1064 K/Pdt.Sus-Pailit/2022. Berdasarkan hal tersebut, ditemukan permasalahan terkait bagaimana kedudukan kreditor pemegang Hak Tanggungan yang berasal dari perjanjian cessie dalam mengajukan tagihan pada proses Penundaan Kewajiban Pembayaran Utang dan Bagaimana pertimbangan hakim pada putusan tersebut dalam menentukan kedudukan kreditor pemegang Hak Tanggungan yang berasal dari perjanjian cessie. Jenis penelitian yang digunakan adalah Penelitian hukum normative dengan menggunakan data sekunder, yaitu data yang telah tersedia sedangkan untuk mendukung data sekunder dilengkapi dengan wawancara. Dari penelitian tersebut, ditemukan bahwa, kedudukan kreditor pemegang Hak Tanggungan yang berasal dari perjanjian cessie dalam mengajukan tagihannya harus terlebih dahulu melakukan pembuatan akta autentik atau akta di bawah tangan terkait pengalihan piutangnya, dan terdapat persyaratan yang harus dipenuhi, seperti penyerahan piutang harus diberitahukan secara resmi kepada debitor atau disetujui/diakui oleh debitor. / Bankruptcy is a commercial resolution method with the aim of being free from debt and receivable problems that burden a debtor when the debtor no longer has the ability to pay off these debts to his creditors. Apart from settlement through Bankruptcy, Debtors can apply for a postponement of debt payment obligations (PKPU) to the commercial court with the aim of submitting a peace plan which includes payment of all or part of their debt to their creditors, so that bankruptcy does not occur. Creditors who submit claims will be classified into 3 (three) types of creditors, based on the explanation in Article 2 paragraph (1) UUK-PKPU, in this case namely concurrent creditors, separatist creditors and preferred creditors. A separatist creditor is a creditor who holds material security rights over his receivables. This research is based on peace decision Number 376/Pdt.Sus-PKPU/2021/PN Niaga Jkt.Pst jo. 1064 K/Pdt.Sus-Pailit/2022. Based on this, problems were found related to the position of creditors holding mortgage rights originating from a cessie agreement in submitting bills during the Postponement of Debt Payment Obligation process and how the judge considered the decision in determining the position of creditors holding mortgage rights originating from a cessie agreement. The type of research used is normative legal research using secondary data, namely data that is already available, while to support secondary data it is supplemented by interviews. From this research, it was found that, the position of creditors holding Mortgage Rights originating from a cessie agreement in submitting their claims must first make an authentic deed or private deed regarding the transfer of their receivables, and there are requirements that must be fulfilled, such as the transfer of receivables must be officially notified. to the debtor or approved/recognized by the debtor.
