Abstract

Dalam ajaran ilmu Trias Politika, dikenal adanya pemisahan kekuasaan dalam suatu pemerintahan. Di Indonesia sendiri mengadopsi ajaran Trias Politika dengan dilakukan modifikasi menjadi pembagian kekuasaan Negara. Kekuasaan Negara berdasarkan Undang-Undang Dasar Tahun 1945 terbagi atas Eksekutif, Legislatif, dan Yudikatif. Berkaitan dengan upaya penegakan supremasi hukum dan keadilan yang berdasarkan Pancasila, Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD NRI 1945) dan peraturan perundang-undangan lainnya, salah satu instrumen penting dalam sistem kekuasaan Negara adalah kekuasaan kehakiman. Kekuasaan kehakiman termasuk kekuasaan Negara Yudikatif, yang terdiri atas Mahkamah Agung, Mahkamah Konstitusi, dan Komisi Yudisial. Kekuasaan kehakiman merupakan kekuasaan Negara yang Merdeka dan Mandiri atau arti lainnya yaitu Independen, dalam menyelenggarakan peradilan umum di Indonesia. Sebagai Lembaga Negara, Mahkamah Agung dan Komisi Yudisial memiliki kewenangan untuk melakukan pengawasan dan menjatuhkan sanksi kepada Hakim yang terbukti melakukan pelanggaran atas perilaku indisipliner. Sanksi pelanggaran Kode Etik Pedoman Perilaku Hakim (KEPPH) terbagi atas sanksi ringan, sedang dan berat. Sanksi berat berlaku dengan pemberhentian secara tidak hormat Hakim terlapor. Penjatuhan sanksi pemberhentian secara tidak hormat dilakukan melalui persidangan yang diselenggarakan oleh Majelis Kehormatan Hakim yang dibentuk oleh anggota dari Mahkamah Agung dan Komisi Yudisial. Majelis Kehormatan Hakim beranggotakan 7 (tujuh) anggota yaitu 3 (tiga) anggota dari Mahkamah Agung dan 4 (empat) dari Komisi Yudisial. Majelis Kehormatan Hakim dibentuk sesuai dengan kebutuhan dan bersifat tidak tetap. Bahwa meskipun masih berada dalam satu kekuasaan kehakiman, Majelis Kehormatan Hakim harus tetap menjunjung tinggi prinsip-prinsip kehakiman termasuk prinsip independensi untuk menciptakan keadilan tanpa keberpihakan seseorang atau institusi yang dinaungi./In the teachings of Trias Politics, it is known that there is a separation of powers in a government. In Indonesia itself, the teachings of Trias Politika were adopted with modifications to the division of state power. State power based on 1945 Constitution is divided into Executive, Legislative and Judicial. In connection with efforts to uphold the supremacy of law and justice based on Pancasila, the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945) and other statutory regulations, one of the important instruments in the state power system is judicial power. Judicial power includes the power of the Judicial State, which consists of the Supreme Court, Constitutional Court and Judicial Commission. Judicial power is the power of an independent and independent state or another meaning, namely independent, in administering general justice in Indonesia. As State Institutions, the Supreme Court and the Judicial Commission have the authority to supervise and impose sanctions on Judges who are proven to have committed violations of disciplinary behavior. Sanctions for violating the Code of Ethics for Judges' Code of Conduct (KEPPH) are divided into light, medium and heavy sanctions. Severe sanctions apply including dishonorable dismissal of the reported Judge. Sanctions for dishonorable dismissal are imposed through a trial held by the Honorary Panel of Judges formed by members of the Supreme Court and the Judicial Commission. The Honorary Panel of Judges consists of 7 (seven) members, namely 3 (three) members from the Supreme Court and 4 (four) from the Judicial Commission. The Honorary Panel of Judges is formed according to needs and is not permanent. That even though it is still under one judicial authority, the Honorary Panel of Judges must continue to uphold the principles of the judiciary, including the principle of independence, to create justice without taking sides from the person or institution under its supervision.
