Abstract
Undang-Undang ketenagakerjaan pada pasal 1 angka 1 mengatur mengenai masa
sebelum, selama dan setelah masa hubungan kerja antara pelaku usaha dengan pekerja.
Offering letter merupakan surat penawaran resmi yang telah memenuhi kualifikasi dari
perusahaan dengan melalui rangkaian proses sesuai kebijakan perusahaan yang
menguraikan posisi yang akan posisi yang akan dijabat, besaran upah dan tunjangan,
dan serta tanggal efektif bekerja yang ditawarkan oleh perusahaan kepada calon tenaga
kerja. Offering letter berbeda dengan perjanjian kerja, akan tetapi offering letter
termasuk kedalam kategori suatu perjanjian. Sehingga Offering letter merupakan surat
penawaran resmi dari perusahaan yang telah memenuhi kualifikasi dari perusahaan
dengan rangkaian prosedural perusahaan yang memuat uraian hak serta kewajiban
termasuk dalam suatu perjanjian yang telah disepakati oleh kedua belah pihak antara
calon tenaga kerja dengan pelaku usaha yang memiliki kekuatan hukum sebagai
undang-undang bagi yang membuatnya. Oleh karena itu, pembatalan suatu offering
letter secara sepihak terhadap calon tenaga kerja merupakan suatu tindakan yang
melanggar hukum karena mengakibatkan kerugian bagi salah satu pihak. Permasalahan
pada penelitian ini yaitu mengenai implikasi terhadap pembatalan offering letter calon
tenaga kerja secara sepihak dan upaya hukum yang dapat dilakukan oleh calon tenaga
kerja yang mengalami pembatalan secara sepihak. Sehingga peneliti bertujuan untuk
menganalisa implikasi pembatalan offering letter calon tenaga kerja secara sepihak
oleh pelaku usaha yang ditimbulkan serta menganalisa upaya hukum seperti apa yang
dapat dilakukan oleh calon tenaga kerja tersebut yang mengalami kerugian daripada
perlakuan sewenang-wenang pelaku usaha. Metode penelitian yang penulis lakukan
yaitu menggunakan penelitian hukum normatif yuridis yaitu dengan pendekatan
perundang-undangan. Hasil penelitian dari implikasi pembatalan offering letter
sepihak yaitu menimbulkan dampak kerugian bagi calon tenaga kerja sehingga
kehilangan mata pencaharian yang seharusnya diperoleh oleh calon tenaga kerja. Dan
upaya hukum yang dapat dilakukakun oleh calon tenaga kerja yang mengacu pada pasal
1365 KUH Perdata yaitu, pelaku usaha wajib memberikan kompensasi ganti kerugian
kepada calon tenaga kerja berdasarkan aturan hukum yang berlaku. / The labor law in article 1 number 1 regulates the period before, during and after the
employment relationship between business actors and workers. An offer letter is an
official offer letter that has met the company's qualifications by going through a series
of processes in accordance with company policy which outlines the position to be held,
the amount of wages and benefits, and the effective date of work offered by the company
to prospective workers. An offer letter is different from a work agreement, but an
offering letter is included in the category of an agreement. So the Offering Letter is an
official offer letter from a company that has met the company's qualifications with a
series of company procedures that contain a description of the rights and obligations
included in an agreement that has been agreed upon by both parties between the
prospective worker and the business actor which has legal force as law. invite those
who make it. Therefore, unilaterally canceling an offering letter for prospective
workers is an act that violates the law because it results in losses for one of the parties.
The problem in this research is regarding the implications of unilaterally canceling a
prospective worker's offering letter and the legal remedies that can be taken by a
prospective worker who experiences unilateral cancellation. So the researcher aims to
analyze the implications of canceling the offering letters of prospective workers
unilaterally by business actors as well as analyzing what legal remedies can be taken
by prospective workers who experience losses due to arbitrary treatment by business
actors. The research method that the author carried out was using normative juridical
legal research, namely a statutory approach. The research results of the implications
of unilaterally canceling the offering letter are that it has a detrimental impact on
prospective workers resulting in loss of livelihood that should be obtained by
prospective workers. And the legal action that can be taken by prospective workers
refers to article 1365 of the Civil Code, namely, business actors are obliged to provide
compensation to prospective workers based on applicable legal regulations.
