Tujuan penelitian ini untuk menganalisis tindakan eksploitasi air tanah yang berdampak dan berefek terhadap masyarakat dan juga menganalisis upaya pemerintah dalam menjaga kesejahteraan masyarakat sebagaimana yang diamanatkan dalam pembukaan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 terkait dari dampak eksploitasi air tanah yang sudah mulai dirasakan dalam beberapa tahun terakhir ini serta penyebab pelaku usaha sehingga melakukan eksploitasi air tanah yang ditinjau dari teori tanggung jawab serta teori efektivitas sistem hukum oleh Lawrence M. Friedman. Penelitian ini menggunakan studi kepustakaan dengan pendekatan konseptual normatif. Hasil studi menunjukkan bahwa upaya pemerintah masih kurang efektif dalam hal mencegah dan juga mengatasi dampak dari eksploitasi air tanah apabila dikaitkan dengan teori tanggung jawab dan juga teori keefektifan sistem hukum. Teori tanggung jawab menunjukkan kurangnya upaya tanggung jawab dari sisi pemerintah dalam upaya mengsejahterakan masyarakat yang menerima dampak dan efek dari eksploitasi air tanah dan juga dari sisi pelaku usaha yang tidak dapat mempertanggungjawabkan tindakan eksploitasi air tanah yang mereka lakukan kepada masyarakat yang menderita kerugian dari dampak dan efek eksploitasi air tanah. Selain itu upaya pemerintah sebagai instrumen dalam menjalankan kepemerintahan dalam menyikapi tindakan eksploitasi air tanah tidak efektif apabila ditinjau dari teori efektivitas sistem hukum oleh Lawrence M. Friedman yang menjelaskan suatu sistem hukum dapat berjalan secara efektif apabila substansi hukum, struktur hukum dan juga budaya hukum dapat berjalan secara selaras. Selaras dalam hal ini dimaksudkan tidak terdapat adanya pertentangan ataupun tumpang tindih antara substansi hukum, struktur hukum dan budaya hukum. Sistem hukum yang efektif juga harus mempertimbangkan aspek-aspek antara satu dengan yang lainnya sehingga dalam pelaksanaanya masyarakat maupun pemerintah dapat menjanlakan kehidupan bernegara dengan baik dan efektif. / The aim of this research is to analyze groundwater exploitation actions that have an impact and effect on the community and also to analyze the government's efforts to maintain community welfare as mandated in the preamble to the 1945 Constitution of the Republic of Indonesia regarding the impact of groundwater exploitation which has begun to be felt in several recent years and the reasons why business actors exploit groundwater as viewed from the theory of responsibility and the theory of the effectiveness of the legal system by Lawrence M. Friedman. This research uses a literature study with a normative conceptual approach. The results of the study show that government efforts are still less effective in preventing and overcoming the impacts of groundwater exploitation when linked to the theory of responsibility and also the theory of the effectiveness of the legal system. The theory of responsibility shows a lack of responsible efforts on the part of the government in an effort to improve the welfare of the people who receive the impacts and effects of groundwater exploitation and also from the side of business actors who cannot be responsible for the actions of groundwater exploitation that they carry out to the people who suffer losses from the impacts and effects. groundwater exploitation.
