Abstract
Tanggung jawab pemerintah Indonesia dalam melindungi hak-hak pekerja, memperjuangkan upah yang adil, dan memprioritaskan pendidikan untuk persiapan tenaga kerja. Fokusnya adalah pada UU Ketenagakerjaan dan perubahan terkait PKWT dalam Undang-Undang Cipta Kerja, dengan tujuan mencapai harmonisasi regulasi dan perlindungan hak pekerja untuk menjaga keadilan bermartabat di dunia kerja Indonesia. Tujuan dari penelitian ini untuk menganalisis tentang perubahan hak tenaga kerja dan konsep Pemutusan Hubungan Kerja dalam hubungan kerja pada Perjanjian Kerja Waktu Tertentu (PKWT) berdasarkan keadilan bermartabat. Penelitian ini menggunakan metode kepustakaan berbasis konsep normatif. Hasil penelitian membuktikan perubahan hak tenaga kerja melalui PKWT dalam UU Cipta Kerja menunjukkan ketidakseimbangan antara hak pekerja dan kewajiban, dengan potensi ketidakadilan bagi pekerja yang bekerja secara terus-menerus. Konsep PHK sebagai dasar PKWT mencerminkan kompleksitas hubungan kerja, membutuhkan evaluasi terus-menerus untuk memastikan keadilan bermartabat dan perlindungan hak pekerja di lingkungan kerja yang dinamis. untuk memastikan keadilan dalam perubahan hak tenaga kerja melalui PKWT, pemerintah perlu mengawasi implementasi, menegakkan hak-hak pekerja, melibatkan serikat pekerja, dan memastikan perlakuan setara. Diperlukan integrasi ketentuan yang adil bagi pekerja PKWT dan mekanisme penyelesaian sengketa yang efektif. Keterlibatan pihak terkait akan membantu menciptakan kerangka kerja yang seimbang, mendukung keberlanjutan ekonomi, dan melindungi hak-hak pekerja dengan adil. / The Indonesian government's responsibility is to protect workers' rights, fight for fair wages, and prioritize education for workforce preparation. The focus is on the Employment Law and changes related to PKWT in the Job Creation Law, with the aim of achieving regulatory harmonization and protection of workers' rights to maintain dignified justice in the world of work in Indonesia. The aim of this research is to analyze changes in labor rights and the concept of Termination of Employment in employment relations under a Certain Time Work Agreement (PKWT) based on dignified justice. This research uses a literature method based on normative concepts. The research results prove that changes in labor rights through PKWT in the Job Creation Law show an imbalance between workers' rights and obligations, with the potential for injustice for workers who work continuously. The concept of layoffs as the basis for PKWT reflects the complexity of employment relationships, requiring continuous evaluation to ensure justice, dignity and protection of workers' rights in a dynamic work environment. To ensure fairness in changes to labor rights through PKWT, the government needs to monitor implementation, enforce workers' rights, involve trade unions, and ensure equal treatment. Integration of fair provisions for PKWT workers and an effective dispute resolution mechanism is needed. The involvement of relevant parties will help create a balanced framework, support economic sustainability, and protect workers' rights fairly
