Abstract

This research aims to discuss one of the brand disputes in Indonesia, namely the SOLARIA brand with SOLARIS, through a Study of Decision No. 775 K/Pdt.Sus-HKI/2021. The next objective is to analyze the considerations of the Panel of Judges in resolving trademark disputes and determine the protection of the SOLARIA brand against the SOLARIS brand in Decision No. 775 K/Pdt.Sus-HKI/2021. This research uses a type of normative legal research using secondary data consisting of court decisions as primary legal material, statutory regulations, legal principles, books and journals as secondary legal material, and the internet as tertiary legal material. The data acquisition method used in this research is a literature study by analyzing cases that have permanent legal force based on statutory regulations. In analyzing the data obtained, qualitative methods were used. The results of the research and analysis obtained are that the Plaintiff, as the owner of the SOLARIA brand is the registrant and first user of the SOLARIA brand based on a first to file system, so the Plaintiff is the legal owner of the SOLARIA brand and the SOLARIA brand is a well-known brand according to proof of its registration in various countries. The Defendant's registration of the SOLARIS mark was deemed to be in bad faith because there were substantial similarities in terms of shape, sound, and pronunciation. As a result, the Defendant is suspected of registering his mark for his business interests alone, which harms other parties by misleading consumers' knowledge, so the Defendant's SOLARIS trademark application should be rejected by the Directorate General of Intellectual Property in accordance with Article 21 paragraph (1) letter a of the MIG Law. The legal protection obtained by the Plaintiff as the owner of the SOLARIA brand is repressive legal protection by resolving this case through a legal process, wherein in its decision the Panel of Judges granted the Plaintiff's lawsuit, one of which was to declare the SOLARIS brand invalid according to law and reject the cassation request submitted by the Defendant / Penelitian ini bertujuan untuk membahas salah satu sengketa merek di Indonesia, yaitu merek SOLARIA dengan SOLARIS melalui Studi Putusan No. 775 K/Pdt.Sus-HKI/2021. Tujuan selanjutnya adalah untuk menganalisis pertimbangan Majelis Hakim dalam menyelesaikan sengketa merek dan mengetahui perlindungan merek SOLARIA atas merek SOLARIS pada Putusan No. 775 K/Pdt.Sus-HKI/2021. Penelitian ini menggunakan jenis penelitian hukum normatif dengan menggunakan data sekunder yang terdiri dari putusan pengadilan sebagai bahan hukum primer, peraturan perundang-undangan, asas hukum, buku, dan jurnal sebagai bahan hukum sekunder, dan internet sebagai bahan hukum tersier. Metode perolehan data yang digunakan dalam penelitian ini adalah studi kepustakaan dengan menganalisis kasus yang telah berkekuatan hukum tetap berdasarkan peraturan perundang-undangan. Dalam menganalisis data yang diperoleh, digunakan metode kualitatif. Hasil penelitian dan analisis yang diperoleh ialah Penggugat selaku pemilik merek SOLARIA merupakan pendaftar dan pemakai pertama atas merek SOLARIA berdasarkan sistem first to file, sehingga Penggugat adalah pemilik merek SOLARIA secara hukum dan merek SOLARIA merupakan merek terkenal sesuai dengan bukti pendaftarannya di berbagai negara. Pendaftaran merek SOLARIS milik Tergugat dinilai beritikad tidak baik dikarenakan adanya persamaan pada pokoknya dari segi bentuk, bunyi, dan pengucapan. Akibatnya Tergugat diduga mendaftarkan mereknya untuk kepentingan usahanya semata yang merugikan pihak lain dengan menyesatkan pengetahuan konsumen, sehingga permohonan merek SOLARIS milik Tergugat sudah sepatutnya ditolak oleh Direktorat Jenderal Kekayaan Intelektual sesuai Pasal 21 ayat (1) huruf a UU MIG. Perlindungan hukum yang diperoleh Penggugat selaku pemilik merek SOLARIA adalah perlindungan hukum represif dengan cara menyelesaikan perkara ini melalui proses hukum, dimana dalam putusannya Majelis Hakim mengabulkan gugatan Penggugat yang salah satu gugatannya ialah menyatakan merek SOLARIS batal menurut hukum serta menolak permohonan kasasi yang diajukan oleh Tergugat
