Abstract

The utilization of Information Technology and Electronic Transactions should adhere to the principles of legal certainty, usefulness, prudence, good faith, freedom to choose technology, and technological neutrality as stipulated in Law Number 11 of 2008 concerning Information and Electronic Transactions. One application of information technology in government is to provide convenience and legal certainty to the public. The Ministry of Law and Human Rights implements electronic signatures on legal entity approval documents issued. An Electronic Signature is a signature consisting of Electronic Information attached to, associated with, or linked to other Electronic Information used as a verification and authentication tool. This paper aims to discuss the regulations governing the legality of using electronic signatures and the responsibilities concerning the validity of signatures, as well as criminal liability concerning the invalidity of electronic signatures and the proof process if a signature issued by a government official within the Ministry of Law and Human Rights is indicated to have administrative violations related to the issuance of a decision letter. This type of research is normative legal research. Normative legal research conceptualizes law as written in legislation (law in books) or law as rules or norms that serve as a benchmark for human behavior considered appropriate and supported by activities conducted by the activities above. From this research, recommendations were found for the Ministry of Law and Human Rights to implement certified electronic signatures in the legal entity administration system to facilitate the public in proving the legality of documents issued by the Ministry of Law and Human Rights so that the public can obtain legal certainty “/”. Pemanfaatan Teknologi Informasi dan Transaksi Elektronik seharusnya menerapkan asas kepastian hukum, memiliki manfaat, kehati-hatian, iktikad baik,kebebasan memilih teknologi dan netral secara teknologi sebagaimana yang ditetapkan dalam Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik. Salah satu pemanfaatan teknologi informasi didalam pemerintahan untuk memberikan kemudahan sekaligus kepastian hukum kepada masyarakat, Kementerian Hukum dan Hak Asasi Manusia mengimplementasikan tanda tangan elektronik pada dokumen pengesahan badan hukum yang diterbitkan. Tanda Tangan Elektronik sendiri adalah tanda tangan yang terdiri atas Informasi Elektronik yang dilekatkan, terasosiasi atau terkait dengan informasi elektronik lainnya yang digunakan sebagai alat verifikasi dan autentikasi. Penulisan ini bertujuan untuk membahas mengenai peraturan perundangundangan yang mengatur legalitas penggunaan tanda tangan elektronik dan sekaligus tanggung jawab (responsibility) terhadap keabsahan tanda tangan maupun tanggung jawab pidana (liability) terhadap ketidak absahan tanda tangan elektronik dan sekaligus proses pembuktian apabila suatu tanda tangan yang dikeluarkan oleh pejabat pemerintahan dilingkungan Kementerian Hukum dan HAM terindikasi terjadi pelanggaran administratif terkait penerbitan suatu surat keputusan. Jenis penelitian ini adalah penelitian hukum normatif. penelitian hukum normatif adalah penelitian yang mengkonseptualisasikan hukum sebagai apa yang tertulis dalam peraturan perundang-undangan (law in books) atau hukum sebagai aturan atau norma yang menjadi tolak ukur perilaku manusia yang dianggap pantas serta didukung dengan kegiatan yang dilakukan oleh kegiatan diatas. Dari penelitian ini ditemukan rekomendasi agar Kementerian Hukum dan Ham dapat mengimplementasikan tanda tangan elektronik yang sudah tersertifikasi pada sistem administrasi badan hukum agar dapat mempermudah masyarakat dalam pembuktian legalitas atas dokumen yang diterbitkan oleh Kementerian Hukum dan Ham sehingga masyarakat bisa mendapatkan kepastian hukum.
