Abstract
Perlindungan hukum terhadap upah minimum di Indonesia telah mengalami perubahan signifikan pasca pemberlakuan Undang - Undang Cipta Kerja No. 6 Tahun 2023. Perubahan ini melibatkan penghapusan Upah Minimu Sektoral dan Penghapusan Kebutuhan Hidup Layak (KHL) sebagai dasar dalam penetapan upah minimum yang kemudian beralih kepada variabel makro ekonomi seperti inflasi dan pertumbuhan ekonomi. Penetapan upah minimum sepenuhnya berpedoman pada formula kenaikan upah yang telah ditentukan dalam aturan turunan undang-undang cipta kerja yaitu PP 36 tahun 2021 Jo PP 51 tahun 2023 tentang Pengupahan. Undang - Undang Cipta Kerja juga mengarahkan penetapan upah minimum untuk lebih terpusat, di mana pemerintah pusat memberikan pedoman kepada gubernur dalam menetapkan Upah Minimum Provinsi (UMP) dan Upah Minimum Kabupaten/Kota (UMK). Perubahan terhadap norma hukum mengenai upah minimum Pasca Undang - Undang Cipta Kerja diberlakukan, mempengaruhi formula penetapan upah minimum. Perubahan formula upah minimum dalam Undang - Undang Cipta Kerja membuat perhitungan upah minimum menjadi lebih rigid dan dapat membawa kepastian hukum dimana kenaikan upah minimum dapat dihitung dan diprediksi untuk masa yang akan datang, namun dengan dihapusnya Upah Minimum Sektoral (UMS) dan ketentuan terhadap pencapaian KHL sebagai dasar dalam menentukan upah minimum seolah mengabaikan perlindungan hukum dan keadilan bagi pekerja. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap upah minimum pekerja yang mencakup aspek kesejahteraan dan keadilan dalam penetapan upah minimum. / Legal protection for minimum wages in Indonesia has undergone significant changes following the enactment of the Act no. 6 of 2023. These changes include the elimination of Sectoral Minimum Wages and the Elimination of Decent Living Requirements (KHL) as the basis for determining minimum wages which then shifts to macroeconomic variables such as inflation and economic growth. Determination of the minimum wage is completely guided by the wage increase formula that has been determined in the derivative regulations of the Act no.6 of 2023, PP 36 of 2021 in conjunction with PP 51 of 2023 concerning Wages. The Act no.6 of 2023 also stipulates the determination of minimum wages for greater clarity, where the central government provides guidelines to governors in determining the Provincial Minimum Wage (UMP) and Regency/City Minimum Wage (UMK). Changes to legal norms regarding minimum wages after the Act no.6 of 2023 have an impact on the formula for determining minimum wages. Changes to the minimum wage formula in the Act no.6 of 2023 make minimum wage calculations more rigid and can bring legal certainty where minimum wage increases can be calculated and predicted for the future, however with the elimination of the Sectoral Minimum Wage (UMS) and the provisions on KHL as The basis for determining minimum wages seems to ignore legal protection and justice for workers. This research aims to analyze legal protection for workers' minimum wages which includes aspects of welfare and justice in determining minimum wages.
