Abstract

Pembentukan Komisi Yudisial sebagai lembaga negara merupakan amanat dari Pasal 24B UUD 1945. Untuk menjalankan amanat tersebut, dibentuk Undang-Undang Nomor 22 Tahun 2004 tentang Komisi Yudisial sebagaimana telah diubah dengan Undang-Undang Nomor 18 Tahun 2011 tentang Perubahan atas Undang-Undang Nomor 22 Tahun 2004 tentang Komisi Yudisial. Untuk melaksanakan wewenangnya, yaitu menjaga dan menegakkan kehormatan, keluhuran martabat, serta perilaku hakim, Komisi Yudisial berpedoman pada Kode Etik dan/atau Kode Perilaku Hakim (KEPPH). Dalam praktiknya, terdapat pertimbangan hakim dalam Putusan Pengadilan Negeri Palu Nomor: 102/Pdt.G/2022/PN Pal. jo. Putusan Pengadilan Tinggi Sulawesi Tengah Nomor: 29/PDT/2023/PT PAL yang didasarkan pada bukti-bukti yang tidak pernah diajukan Penggugat dalam persidangan. Tindakan Majelis Hakim dalam putusan tersebut bertentangan dengan Pasal 53 Undang-Undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman yang menegaskan bahwa putusan harus memuat pertimbangan hukum hakim berdasarkan alasan dan dasar hukum yang tepat dan benar. Nomor 10 jo. Pasal 14 KEPPH juga mengatur bahwa hakim wajib bersikap profesional dengan menghindari kekeliruan dalam mengambil keputusan. Namun, fakta yang terjadi adalah hakim telah keliru dalam membuat putusan dan melanggar KEPPH. Komisi Yudisial berwenang menegakkan KEPPH dengan mengusulkan sanksi terhadap hakim yang bersangkutan dengan mempertimbangkan beberapa hal, yaitu adanya indikasi, bukti, unsur sengaja, dan dampak dari putusan yang mengandung kekeliruan hakim tersebut. Tujuan penelitian ini adalah untuk memperdalam pengetahuan tentang kewenangan Komisi Yudisial dalam menegakkan KEPPH terhadap kekeliruan hakim dan memecahkan persoalan hukum, yaitu terhadap hakim yang keliru sebagaimana tercantum dalam Putusan Pengadilan Negeri Palu Nomor: 102/Pdt.G/2022/PN Pal. jo. Putusan Pengadilan Tinggi Sulawesi Tengah Nomor: 29/PDT/2023/PT PAL. Jenis penelitian secara normatif empiris. / The establishment of the Judicial Commission as a state institution is a mandate from Article 24B of the 1945 Constitution. To carry out this mandate, Law Number 22 of 2004 concerning the Judicial Commission was formed as amended by Law Number 18 of 2011 concerning Amendments to Law Number 22 of 2004 concerning the Judicial Commission. To carry out its authority, namely maintaining and upholding the honor, dignity, and behavior of judges, the Judicial Commission is guided by the Code of Ethics and Code of Conduct for Judges (KEPPH). In practice, judges' considerations are in the Palu District Court Decision Number: 102/Pdt.G/2022/PN Pal. jo. Central Sulawesi High Court Decision Number: 29/PDT/2023/PT PAL is based on evidence that the Plaintiff never submitted in the trial. The action of the Panel of Judges in the decision is contrary to Article 53 of Law Number 48 of 2009 concerning Judicial Power which emphasizes that the verdict must contain the judge's legal considerations based on appropriate and correct legal reasons and grounds. Number 10 jo. Article 14 of the KEPPH also stipulates that judges are obliged to be professional by avoiding mistakes in making decisions. However, the fact that occurred was that the judge had made a mistake in making a decision and violated the KEPPH. The Judicial Commission is authorized to enforce the KEPPH by proposing sanctions against the judge concerned by considering several things, namely the existence of indications, evidence, elements of intentionality, and the impact of the decision that contains the judge's error. The purpose of this research is to deepen knowledge about the authority of the Judicial Commission in enforcing the KEPPH against judges' mistakes and solving legal problems, namely against erroneous judges as stated in the Palu District Court Decision Number: 102/Pdt.G/2022/PN Pal. jo. Central Sulawesi High Court Decision Number: 29/PDT/2023/PT PAL. The type of research is normatively empirical.
