Abstract

"Pengaturan mengenai Undang-Undang Pidana Administratif di Indonesia sudah dilakukan sejak zaman orde baru. Namun, penerapannya masih dinilai belum efektif dimana tiap ketentuan Undang-Undang Pidana Administratif memliki perbedaan mengenai tata cara dan prosedur penjatuhan sanksi administratif maupun sanksi pidana pada hukum pidana. Sehingga, kepastian hukum baik dalam bentuk konsep maupun penerapannya belum dapat tercapai secara maksimal khususnya mengenai proses penegakan terhadap tindak pidana pemberian ijazah secara tanpa hak pada jenjang pendidikan tinggi yang cenderung prosesnya tidak sesuai dengan tujuan pemidanaan yang memberikan efek jera dan memberikan manfaat kepada pelaku tindak pidananya. Karenanya, penelitian ini bertujuan untuk membahas urgensi dari asas ultimum remedium yang harus dinormakan dalam Undang-Undang Pidana Administrasi khususnya Undang-Undang Nomor 20 Tahun 2003 tentang Sistem Pendidikan Nasional. Penelitian yang dilakukan menggunakan metode penelitian Hukum Normatif dimana pengumpulan, penulisan, klasifikasi dan analisis dari penelitian ini menggunakan bahan hukum yang diperoleh dari berbagai dokumen tertulis, khususnya peraturan perundang-undangan, studi kasus, kaidah atau norma yang berlaku dalam hukum positif, dan analisis yang menggunakan bahan hukum primer, sekunder dan tersier dalam menganalisis baik ketentuan sanksi administratif dan pidana khususunya peraturan perundang-undangan yang mengatur pendidikan tinggi dalam studi penelitian ini. Melalui penelitian ini, penerapan dari sanksi administrasi dan sanksi pidana seyogyanya harmonis baik dalam penormaan dan penegakan hukumnya. Penerapan dari pembuat undang-undang mengatur mekanisme pelaksanaan sanksi pelanggaran dan kejahatan yang mengacu pada Pasal 103 KUHP harus dilaksanakan sehingga penerapan asas ultimum remedium dapat tercapai dengan baik." / "The regulation of Administrative Penal Law ini Indonesia has been carried out since the new order era. However, its implementation is still considered ineffective where each provision of the Administrative Penal Law has differences regarding the procedures and procedures of imposing administrative sanctions and criminal sanctions in criminal law. Sot that legal certainty, both in the form of concept and its application, cannot be achieved optimally, especially regarding the criminal law enforcement process of granting diplomas without rights at the higher education leve, which tends to be a process that is not in accordance with the aim of punishment which provides a deterrent effect and provides benefits to the perpetrators of criminal acts. Therefore, this research aims to discuss the urgency of the ultimum remedium principle which must be normalized in the Administrative Penal Law, especially Law Number 20 of 2003 concernung the National Education System. The research was carried out using Normative Law research methods where the collection, writing classification and analysis of this research used legal materials obtained from various written documents, especially statutory regulations, case studies, rules or norms that applicable in positive law, and analysis using primary, secondary, and tertiary legal materials in analyzing both administrative and criminal sanctions provisions, especially laws and regulations governing higher education in this research study. Through this research, the application of administrative sancttions and criminal sanctions should be in harmony with both norms and law enforcement. The implementation fo the law maker which regulates the mechanism for implementing sanctions for violations and crimens which refers to Article 103 of the Criminal Code must be implemented so that the application of the ultimum remedium principle can be achieved properly."
