Indonesia sebagai negara hukum, mendukung para pencipta dengan memberikan perlindungan atas ciptaannya. Hal ini terlihat di Pasal 28C ayat (1) Undang-undang Dasar Negara Indonesia Tahun 1945 yang menyebutkan bahwa setiap orang berhak mengembangkan diri melalui pemenuhan kebutuhan dasarnya, berhak mendapat Pendidikan dan memperoleh manfaat dari ilmu pengetahuan dan teknologi, seni dan budaya, demi meningkatkan kualitas hidupnya dan demi kesejahteraan umat manusia. Inilah yang menjadi satu pertimbangan bagi pemerintah untuk membentuk Undang-undang Nomor 28 Tahun 2014 yang bertujuan untuk melindungi Hak Cipta. Namun sayangnya kasus pelanggaran atas hak cipta masih marak terjadi. Penelitian ini mengkaji dan menganalisa konsep perlindungan hukum terkait dengan larangan plagiarisme karya ciptaan dalam bentuk lagu dan/atau musik menurut Undang-undang nomor 28 tahun 2014 serta efektivitas dari upaya hukum yang dapat diambil oleh Pencipta dalam melindungi ciptaan lagu dan/atau musik sehubungan dengan adanya plagiarisme dengan menggunakan metode penelitian yudiris normatif. Hasil penelitian menemukan bahwa banyak pihak yang belum mengerti konsep pelanggaran hak cipta. Hal ini dibuktikan dengan beberapa kasus yang terjadi. Ditambah lagi dikarenakan tidak adanya suatu aturan pelaksana terkait dengan bagaimana proses pemeriksaan untuk dapat menentukan tolak ukur plagiarisme serta tindakan konkret dari pemerintah untuk dapat mencegah perbuatan-perbuatan plagiarisme maka menjadikan UU Hak Cipta menjadi kurang efektif. Satu-satunya cara agar perlindungan hak cipta dapat efektif adalah dengan membangun budaya hukum untuk menghormati, menghargai, dan melidungi hak orang lain. / Indonesia, as a rule of law state, supports creators by providing protection for their creations. This research examines and analyzes the concept of legal protection related to the prohibition of plagiarism of written works in the form of songs and/or music according to Copyright Law number 28 of 2014 as well as the effectiveness of legal measures that can be taken by creators in protecting song and/or music creations in connection with the existence of plagiarism using normative judicial research methods. The research results found that many rule makers and legal officials do not really understand the concept of copyright infringement. In addition, due to the absence of implementing regulations regarding the inspection process to determine benchmarks for plagiarism as well as concrete actions from the government to prevent acts of plagiarism, this makes the Copyright Law less effective. The only way for copyright protection to be effective is to build a legal culture to respect, respect and protect the rights of others.
