Abstract
Dalam mewujudkan institusi yang maju, modern, dan berkelas dunia, Kementerian Agraria dan Tata Ruang / Badan Pertanahan Nasional mencanangkan Layanan Elektronik Hak Tanggungan. Sistem pendaftaran hak tanggungan elektronik terintegrasi dengan Dukcapil dalam hal input dan pengecekan Nomor Induk Kependudukan (NIK). Dengan memasukan NIK orang yang telah meninggal dunia, maka akan terdeteksi dan otomatis ditolak oleh sistem. Sehingga hak tanggungan tidak bisa didaftarkan karena PPAT tidak bisa melanjutkan pengisian data dalam sistem. Jenis penelitian ini adalah Hukum Normatif-Empiris dengan pengumpulan data secara studi kepustakaan dan melakukan wawancara dengan perwakilan Kantor Pertanahan. Dari hasil penelitian ini disimpulkan bahwa kedudukan pemegang hak tanggungan yang tidak didaftarkan adalah tidak memiliki hak Istimewa atau hak untuk didahulukan mendapatkan pelunasan piutangnya dari kreditur lain. Akibat hukum yang timbul adalah objek hak tanggungan tidak dapat dieksekusi dan dianggap tidak ada karena tidak terjadinya pendaftaran hak tanggungan. Sehingga, harus dilakukan turun waris dan pembuatan Akta Pemberian Hak Tanggungan baru oleh ahli waris selaku pemberi hak tanggungan yang baru untuk didaftarkan Kembali. / In realizing an advanced, modern, and world-class institution, the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency launched the Mortgage Electronic Service. The electronic mortgage registration system is integrated with Dukcapil in terms of inputting and checking the Population Registration Number (NIK). By entering the NIK of a person who has passed away, it will be detected and automatically rejected by the system. So that the mortgage cannot be registered because the PPAT cannot continue filling in the data in the system. This type of research is Normative-Empirical Law with data collection by literature study and conducting interviews with representatives of the Land Office. From the results of this study, it is concluded that the position of the holder of an unregistered mortgage right is that it does not have special rights or rights to take precedence in obtaining repayment of its debts from other creditors. The legal consequences that arise are that the object of the mortgage cannot be executed and is considered non-existent because there is no registration of the mortgage. Thus, the inheritance must be carried out and a new Deed of Granting Mortgage must be made by the heirs as the new mortgagor to be re-registered.
