Abstract
The advancement of information and communication technology brought
significant changes to various aspects of life, including the legal activities. One of
the no impacts is the emergence of the Cyber Notary concept, an electronic system for creating and drafting notarial deeds. This study aims to examine the Cyber Notary concept within the context of notarial law in Indonesia and to analyze its implications for the validity of authentic deeds. In this research, the author
elaborates on and investigates the discrepancies between the existing regulations
in the Notarial Law and the reality in the performance of notarial duties as well as
the lack of regulations related to technological aspects in the creation of notarial
authentic deeds. This study finds that the Cyber Notary concept holds immense
potential for enhancing the efficiency and effectiveness of notarial services.
However, there is still considerable constraint in implementation in Indonesia
because of existing legal regulations. This leads to legal uncertainty and hesitation
among notaries and society in adopting the concept. The uncertainty regarding the
authority and responsibilities of notaries in carrying out their duties through Cyber
Notary might cause various issues, such as legal disputes, misuse of technology,
and violations of notarial ethics. Therefore, in-depth research is necessary to
examine the authority and responsibilities of notaries regarding the deeds created
using the Cyber Notary concept. This study also finds that Cyber Notary Activities
have implications for the validity of authentic deeds. The validity of electronically
created authetic deeds needs to be further examined by considering both legal and technological aspects. It is important to ensure that electronically created authentic deeds have the same legal force as conventionally created ones. Based on the findings of this research, it is concluded that the transformation of notarial services in the digital era through the implementation of Cyber Notary requires robust, clear, and comprehensive legal regulations. This is important to ensure legal certainty and protect the rights of all parties involved in the drafting of authentic deeds.
