Proses lisensi dimulai dengan dibuatnya suatu perjanjian lisensi antara pihak terlibat dalam rangka menuangkan kesepakatan yang telah dijalani oleh dua belah pihak terkait lisensi atas merek. Selanjutnya, dengan adanya pengajuan pencatatan perjanjian lisensi secara tertulis dalam Bahasa Indonesia kepada Menteri melalui media elektronik atau non-elektronik. Pemeriksaan dokumen dilakukan dalam dua tahap, yaitu pemeriksaan kelengkapan dan verifikasi kesesuaian dokumen. Berdasarkan hasil penelitian, peraturan perundang-undangan di Indonesia, termasuk Undang-Undang Nomor 20 Tahun 2016 Tentang Merek Dan Indikasi Geografis, Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 8 Tahun 2016 Tentang Syarat Dan Tata Cara Permohonan Pencatatan Perjanjian Lisensi Kekayaan Intelektual, serta Peraturan Pemerintah Nomor 36 Tahun 2018 Tentang Pencatatan Perjanjian Lisensi Kekayaan Intelektual, mengatur bahwa dokumen yang diperlukan meliputi salinan perjanjian lisensi, sertifikat merek, dan surat kuasa jika permohonan diajukan melalui kuasa. Subsequently, a written application for the recording of the licensing agreement in Indonesian submitted to the Minister through electronic or non-electronic media.
