Abstract

Provisions regarding bank secrecy and exceptions to the enforcement of bank secrecy provisions. Republic of Indonesia Law Number 10 Year 1998 jo. Law of the Republic of Indonesia Number 7 of 1992 concerning Banking and Bank Indonesia Regulation Number 2/19 / PBI / 2000 are prepared to provide legal protection for the disclosure of bank secrets to the heirs of depositing customers who have died. In this study, the problem examined is how to regulate bank secrets according to the applicable laws and regulations and the legal consequences of opening bank secrecy in the presence of heirs of depositing customers who have died. The purpose of this study is to analyze bank secrets according to the applicable laws and regulations and the legal consequences of opening bank secrecy in the presence of heirs of depositing customers who have died. The technique of data collection is carried out using a statutory approach, namely by using a literature study on banking secrecy. From the results of this study, it can be concluded that the provisions regarding the requirements and procedures for the issuance of written orders or permits to disclose bank secrets as stipulated in Bank Indonesia Regulation Number 2/19 / PBI / 2000 cannot fully guarantee legal protection for heirs of depositary customers who have died world regulated in the Banking Act and Bank Indonesia Regulation. The implementation of the regulation regarding the disclosure of bank secrets failed to realize the goal of providing legal protection for the heirs of depositing customers who have died. / Ketentuan tentang kerahasiaan bank dan pengecualian-pengecualian atas berlakunya ketentuan rahasia bank. Undang-Undang Republik Indonesia Nomor 10 Tahun 1998 jo. Undang-Undang Republik Indonesia Nomor 7 Tahun 1992 tentang Perbankan dan Peraturan Bank Indonesia Nomor 2/19/PBI/2000 disusun untuk memberikan perlindungan hukum bagi pembukaan rahasia bank terhadap ahli waris nasabah penyimpan yang telah meninggal dunia. Dalam penelitian ini, permasalahan yang diteliti yaitu bagaimana pengaturan mengenai rahasia bank menurut peraturan perundang-undangan yang berlaku dan akibat hukum dari pembukaan kerahasiaan bank di hadapan ahli waris nasabah penyimpan yang telah meninggal dunia. Tujuan penelitian yaitu untuk menganalisis mengenai rahasia bank menurut peraturan perundang-undangan yang berlaku dan akibat hukum dari pembukaan kerahasiaan bank di hadapan ahli waris nasabah penyimpan yang telah meninggal dunia. Teknil pengumpulan data dilakukan dengan menggunakan pendekatan perundang-undangan, yaitu dengan menggunakan studi kepustakaan mengenai kerahasiaan perbankan. Dari hasil penelitian tersebut, dapat disimpulkan bahwa ketentuan mengenai persyaratan dan tata cara pemberian perintah atau izin tertulis membuka rahasia bank yang diatur dalam Peraturan Bank Indonesia Nomor 2/19/PBI/2000 belum dapat sepenuhnya menjamin perlindungan hukum bagi ahli waris nasabah penyimpan yang telah meninggal dunia yang diatur dalam Undang-Undang Perbankan dan Peraturan Bank Indonesia tersebut. Implementasi pengaturan mengenai pembukaan rahasia bank gagal mewujudkan tujuan memberikan jaminan perlindungan hukum terhadap ahli waris nasabah penyimpan yang telah meninggal dunia.
